1 1 Section 1. Section 56.5A, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3. a. A candidate's committee shall not
1 4 accept contributions from sources other than individuals who
1 5 permanently reside within the district represented by the
1 6 office to which the candidate presently seeks election, unless
1 7 the candidate's committee has received and deposited in the
1 8 candidate's campaign account an equal or greater total of
1 9 contributions from individuals who permanently reside within
1 10 the district.
1 11 b. Notwithstanding section 56.16, a candidate who accepts
1 12 a contribution in violation of this subsection shall be fined
1 13 civilly in an amount equal to ten times the amount by which
1 14 the contribution exceeded the permitted limit. The fine
1 15 proceeds shall be deposited in the Iowa election campaign fund
1 16 created in section 56.19.
1 17 EXPLANATION
1 18 This bill amends Code chapter 56 to restrict a candidate's
1 19 committee's acceptance of contributions from individuals who
1 20 reside outside of the candidate's district. A candidate would
1 21 be permitted to accept funds from such individuals only up to
1 22 an amount equal to the amount of funds that the candidate has
1 23 collected from individuals who reside within the candidate's
1 24 district.
1 25 The penalty for violation of this prohibition is a civil
1 26 fine equal to 10 times the amount accepted in excess of the
1 27 limitation. Pursuant to Code section 68B.32, the fine could
1 28 be imposed by the board if it were no more than $2,000; if the
1 29 fine were more than $2,000, the board could refer the matter
1 30 to the attorney general or appropriate county attorney. The
1 31 fine proceeds are to be deposited in the election campaign
1 32 fund.
