  1  1    Section 1.  Section 670.4, subsection 11, Code 2001, is
  1  2 amended to read as follows:
  1  3    11.  A claim based upon or arising out of an act or
  1  4 omission in connection with an emergency response including
  1  5 but not limited to acts or omissions in connection with
  1  6 emergency response communications services.  This subsection
  1  7 shall not apply to claims based upon gross negligence.  
  1  8                           EXPLANATION
  1  9    This bill provides that a political subdivision of the
  1 10 state will not be exempt from liability regarding an emergency
  1 11 response claim where the act or omission in connection with
  1 12 the emergency response constitutes gross negligence.
