  1  1    Section 1.  Section 257.18, subsection 1, Code 2001, is
  1  2 amended to read as follows:
  1  3    1.  An instructional support program that provides
  1  4 additional funding for school districts is established.  A
  1  5 board of directors that wishes to consider participating in
  1  6 the instructional support program shall hold a public hearing
  1  7 on the question of participation.  The board shall set forth
  1  8 its proposal, including the method that will be used to fund
  1  9 the program, in a resolution and shall publish the notice of
  1 10 the time and place of a public hearing on the resolution.
  1 11 Notice of the time and place of the public hearing shall be
  1 12 published not less than ten nor more than twenty days before
  1 13 the public hearing in a newspaper which is a newspaper of
  1 14 general circulation in the school district.  At the hearing,
  1 15 or no later than thirty days after the date of the hearing,
  1 16 the board shall take action to adopt a resolution to
  1 17 participate in the instructional support program for a period
  1 18 not exceeding five years or to direct the county commissioner
  1 19 of elections to submit the question of participation in the
  1 20 program for a period not exceeding ten years to the registered
  1 21 voters of the school district at the next regular school
  1 22 election or at a special election.  If the board adopts a
  1 23 resolution to participate in the instructional support program
  1 24 for a period not exceeding five years, the board shall certify
  1 25 its action to the department of management and the district
  1 26 shall participate in the program.  If the board submits the
  1 27 question at an election and a majority of those voting on the
  1 28 question favors participation in the program, the board shall
  1 29 adopt a resolution to participate and certify the results of
  1 30 the election to the department of management.
  1 31    Sec. 2.  Section 257.18, subsection 2, Code 2001, is
  1 32 amended by striking the subsection.  
  1 33                           EXPLANATION
  1 34    This bill provides that a school district board of
  1 35 directors may adopt a resolution to participate in the
  2  1 instructional support program pursuant to Code section 257.18
  2  2 for a period of five years and certify this action to the
  2  3 department of management without providing for a reverse
  2  4 referendum.  Currently, a decision by the board to participate
  2  5 in the instructional support program for a five-year period is
  2  6 subject to the subsequent receipt by the board of a petition
  2  7 containing a specified number of signatures, asking that an
  2  8 election be called to approve or disapprove the action of the
  2  9 board.  Upon receipt of the petition, the board may either
  2 10 rescind its action or direct the county commissioner of
  2 11 elections to submit the question to the registered voters of
  2 12 the school district at the next following regular school
  2 13 election or a special election.  If a majority of those voting
  2 14 on the question at the election favors disapproval of the
  2 15 action of the board, the district shall not participate in the
  2 16 instructional support program.  The bill provides that the
  2 17 decision of the board to participate shall not be contingent
  2 18 upon a subsequent receipt of a petition and an election.
