  1  4 RELATING TO THE QUALIFICATIONS AND AUTHORIZATION OF 
  1  5    THERAPEUTICALLY CERTIFIED OPTOMETRISTS ENGAGED IN THE
  1  6    PRACTICE OF OPTOMETRY, AND PROVIDING AN EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 154.1, unnumbered paragraph 3, Code
  1 11 2001, is amended to read as follows:
  1 12    Therapeutically certified optometrists may employ the
  1 13 following pharmaceuticals:  topical pharmaceutical agents,
  1 14 oral antimicrobial agents, oral antihistamines, oral
  1 15 antiglaucoma agents, and oral analgesic agents, all diagnostic
  1 16 and therapeutic pharmaceutical agents for the purpose of
  1 17 diagnosis and treatment of conditions of the human eye and
  1 18 adnexa, pursuant to this paragraph, excluding the use of
  1 19 injections other than to counteract an anaphylactic reaction,
  1 20 and notwithstanding section 147.107, may without charge supply
  1 21 any of the above listed pharmaceuticals to commence a course
  1 22 of therapy.  Therapeutically certified optometrists may
  1 23 prescribe oral steroids for a period not to exceed fourteen
  1 24 days without consultation with a primary care physician.
  1 25 Therapeutically certified optometrists shall not prescribe
  1 26 oral Imuran or oral Methotrexate.  Therapeutically certified
  1 27 optometrists may be authorized, where reasonable and
  1 28 appropriate, by rule of the board, to employ new diagnostic
  1 29 and therapeutic pharmaceutical agents approved by the United
  1 30 States food and drug administration on or after July 1, 2002,
  1 31 for the diagnosis and treatment of the human eye and adnexa.
  1 32 The board shall not be required to adopt rules relating to
  1 33 topical pharmaceutical agents, oral antimicrobial agents, oral
  1 34 antihistamines, oral antiglaucoma agents, and oral analgesic
  1 35 agents.  Superficial foreign bodies may be removed from the
  2  1 human eye and adnexa.  These The therapeutic efforts of a
  2  2 therapeutically certified optometrist are intended for the
  2  3 purpose of examination, diagnosis, and treatment of visual
  2  4 defects, abnormal conditions and diseases of the human eye and
  2  5 adnexa, for proper optometric practice or referral for
  2  6 consultation or treatment to persons licensed under chapter
  2  7 148 or 150A.  A therapeutically certified optometrist is an
  2  8 optometrist who is licensed to practice optometry in this
  2  9 state and who is certified by the board of optometry examiners
  2 10 to use the agents and procedures listed in authorized pursuant
  2 11 to this paragraph.  A therapeutically certified optometrist
  2 12 shall be provided with a distinctive certificate by the board
  2 13 which shall be displayed for viewing by the patients of the
  2 14 optometrist.
  2 15    Sec. 2.  EMERGENCY RULES.  The board of optometry examiners
  2 16 may adopt emergency rules under section 17A.4, subsection 2,
  2 17 and section 17A.5, subsection 2, paragraph "b", to implement
  2 18 the provisions of this Act, and the rules shall become
  2 19 effective immediately upon filing, unless a later effective
  2 20 date is specified in the rules.  Any rules adopted in
  2 21 accordance with the provisions of this section shall also be
  2 22 published as notice of intended action as provided in section
  2 23 17A.4.
  2 24    Sec. 3.  EFFECTIVE DATE.  Section 2 of this Act, relating
  2 25 to the adoption of emergency rules, being deemed of immediate
  2 26 importance, takes effect upon enactment.
