  1  1    Section 1.  NEW SECTION.  306.46  ROAD MARKINGS – LUMINOUS
  1  2 PAINT.
  1  3    The agency that has jurisdiction over a road or street,
  1  4 when painting lane markings on the road or street for the
  1  5 first time or when remarking the road or street, shall use
  1  6 luminous paint or paint mixed with a luminous additive.
  1  7    Sec. 2.  Section 321.384, Code 2001, is amended to read as
  1  8 follows:
  1  9    321.384  WHEN LIGHTED LAMPS REQUIRED.
  1 10    1.  Every A motor vehicle operated upon a highway within
  1 11 the this state, shall display lighted headlamps as provided in
  1 12 section 321.415 at any time from sunset to sunrise, at any
  1 13 time the motor vehicle's windshield wipers are in continuous
  1 14 operation, and at such other times when conditions such as
  1 15 fog, snow, sleet, or rain provide insufficient lighting to
  1 16 render clearly discernible persons and vehicles on the highway
  1 17 at a distance of five hundred feet ahead, shall display
  1 18 lighted head lamps as provided in section 321.415, subject to
  1 19 exceptions with respect to parked vehicles as hereinafter
  1 20 stated under this chapter.
  1 21    2.  Whenever A requirement is hereinafter declared as to
  1 22 regarding the distance from which certain lamps and devices
  1 23 shall render objects visible or within which such lamps or
  1 24 devices shall be visible, said provisions shall apply during
  1 25 the times stated in subsection 1 of this section upon a
  1 26 straight level unlighted highway under normal atmospheric
  1 27 conditions unless a different time or condition is expressly
  1 28 stated.
  1 29    Sec. 3.  WARNING CITATIONS.  During the first six months
  1 30 following the effective date of this Act, peace officers shall
  1 31 issue only warning citations for the following:
  1 32    1.  Motor vehicles not displaying lighted headlamps at any
  1 33 time the motor vehicle's windshield wipers are in continuous
  1 34 operation as required by section 321.384, subsection 1, as
  1 35 amended in this Act.
  2  1    2.  Persons violating other lighting provisions in chapter
  2  2 321 which require the use of certain lights at any time the
  2  3 motor vehicle's windshield wipers are in continuous operation
  2  4 as required by section 321.384, subsection 1, as amended in
  2  5 this Act.
  2  6    Sec. 4.  NOTICE OF SAFE DRIVING COURSES.  The state
  2  7 department of transportation and county treasurer's offices
  2  8 participating in county issuance of driver's licenses pursuant
  2  9 to chapter 321M shall post in a prominent location at all
  2 10 driver's license stations a sign or signs providing
  2 11 information on safe driving refresher courses such as the
  2 12 American association of retired persons (AARP) 55 alive
  2 13 program.  
  2 14                           EXPLANATION
  2 15    This bill requires agencies having jurisdiction over a road
  2 16 or street to use luminous paint or paint with a luminous
  2 17 additive when painting lane markings on the road or street for
  2 18 the first time or when remarking the road or street.
  2 19    The bill amends Code section 321.384 by requiring a motor
  2 20 vehicle to display lighted headlights at any time when the
  2 21 vehicle's wipers are in continuous operation.  The bill also
  2 22 requires the use of other types of vehicle lights when the
  2 23 vehicle's wipers are in operation by current Code references
  2 24 to Code section 321.415.  A violation of these provisions is a
  2 25 simple misdemeanor punishable by a scheduled fine of $20 under
  2 26 Code section 805.8.  The bill also provides that during the
  2 27 first six months following enactment, violations of these
  2 28 provisions will only result in warning citations.
  2 29    The bill also requires the state department of
  2 30 transportation and county treasurer's offices participating in
  2 31 county issuance of driver's licenses to post at all driver's
  2 32 license stations a sign or signs providing information on safe
  2 33 driving refresher courses such as the American association of
  2 34 retired persons (AARP) 55 alive program.
