  1  1    Section 1.  NEW SECTION.  53.19A  LISTS OF ABSENTEE VOTERS.
  1  2    1.  Any person may request of the commissioner and shall
  1  3 receive, upon payment of the cost of preparation, a list of
  1  4 absentee voters in accordance with the following requirements
  1  5 and limitations:
  1  6    a.  The commissioner shall prepare each list requested
  1  7 within three days of receipt of the request, except that the
  1  8 commissioner shall not be required to prepare any list within
  1  9 five days of the election for which the list is requested.
  1 10    b.  Each list shall be as current as possible, but shall in
  1 11 all cases reflect absentee voter activity recorded by the
  1 12 commissioner seven or more days before preparation of the
  1 13 list.
  1 14    c.  Each list shall be in the order and form specified by
  1 15 the list purchaser, and shall contain the absentee voter data
  1 16 specified by the list purchaser, provided that compliance with
  1 17 the request is within the capability of the record maintenance
  1 18 system used by the commissioner.
  1 19    d.  Absentee voter information shall be maintained in an
  1 20 electronic medium.  The commissioner shall prepare updates to
  1 21 lists at least weekly.  All updates shall be made available to
  1 22 all requesters at the same time, and shall be in the order and
  1 23 form specified by each requester.
  1 24    2.  The commissioner shall maintain a log of the name,
  1 25 address, and telephone number of every person who receives a
  1 26 list under this section, and of every person who reviews
  1 27 absentee voter records in the office of the commissioner.
  1 28 Logs maintained under this subsection are public records, and
  1 29 shall be available for public inspection at reasonable times.
  1 30    3.  Information about absentee voters obtained from
  1 31 absentee voter records shall be used only for a genuine
  1 32 political purpose, or for a bona fide official purpose by an
  1 33 elected official, or for bona fide political research, but
  1 34 shall not be used for any commercial purposes.  A person who
  1 35 uses absentee voter information in violation of this section
  2  1 commits a serious misdemeanor.
  2  2    4.  Lists of absentee voters shall be preserved and
  2  3 destroyed in the same manner as are ballots for elections
  2  4 under section 50.19.  
  2  5                           EXPLANATION
  2  6    This bill requires county commissioners of elections to
  2  7 maintain, and make available to the public upon request, lists
  2  8 of absentee voters.  The lists must be maintained in an
  2  9 electronic medium and shall be updated weekly.  A requested
  2 10 list is to be prepared within three days of receipt of the
  2 11 request.  An absentee voters list may be requested up to five
  2 12 days before the election for which the list is requested.
