1 1 Section 1. NEW SECTION. 231.61 ALTERNATIVE HOUSING –
1 2 ELDER VICTIMS OF ABUSE.
1 3 1. The department shall develop a plan to provide
1 4 alternative housing to elders who are victims of abuse and
1 5 must be removed from the elder's residence in order to ensure
1 6 the safety of the elder. The department shall work with the
1 7 Iowa finance authority, created pursuant to chapter 16, with
1 8 municipal housing agencies created pursuant to section 403A.5,
1 9 and with other persons interested in providing affordable
1 10 housing to determine alternative housing options for elders
1 11 who are victims of abuse. The department shall submit an
1 12 initial plan to the general assembly and to the governor by
1 13 November 1, 2001, and shall submit an updated plan annually on
1 14 or before November 1. The plan submitted shall include an
1 15 estimate of state funding necessary to provide the alternative
1 16 housing identified in the plan.
1 17 2. For the purposes of this section, "elders who are
1 18 victims of abuse" includes elder victims of dependent adult
1 19 abuse as defined in section 235B.2, elder victims of domestic
1 20 abuse as defined in section 236.2, elder victims of wanton
1 21 neglect of a resident of a health care facility pursuant to
1 22 section 726.7, and elder victims of wanton neglect or
1 23 nonsupport of a dependent adult pursuant to section 726.8.
1 24 EXPLANATION
1 25 This bill directs the department of elder affairs to
1 26 develop a plan to provide housing to elders who are victims of
1 27 abuse. The bill directs the department to work with the Iowa
1 28 finance authority, municipal housing agencies, and others who
1 29 are interested in providing affordable housing to develop the
1 30 plan. The plan is to be submitted, initially, to the general
1 31 assembly and the governor by November 1, 2001, and is to be
1 32 updated and submitted annually on November 1. The bill
1 33 defines elders who are victims of abuse for the purposes of
1 34 the bill.
