  1  1    Section 1.  Section 166D.7, subsection 2, paragraph b,
  1  2 unnumbered paragraph 1, Code 2001, is amended to read as
  1  3 follows:
  1  4    In order to remain certified the herd must be retested and
  1  5 recertified as provided by the department.  The herd must be
  1  6 recertified annually.  The herd shall be recertified when a
  1  7 statistical sampling of the herd is determined to be
  1  8 noninfected within.  The statistical sampling shall be
  1  9 conducted at intervals of twelve months from initial
  1 10 certification or the most recent recertification, unless the
  1 11 department determines that a herd is located within an area
  1 12 where a high incidence of infection requires that statistical
  1 13 sampling occur more frequently.  
  1 14                           EXPLANATION
  1 15    This bill amends Code chapter 166D, which authorizes the
  1 16 department of agriculture and land stewardship to regulate
  1 17 pseudorabies, a disease affecting swine.  In 2000, the general
  1 18 assembly enacted SF 2312 (2000 Iowa Acts, chapter 1110) that
  1 19 substantially revised the chapter.  On July 26, 2000, the
  1 20 department filed rules amending a number of its regulations,
  1 21 including provisions affecting certification requirements for
  1 22 certain noninfected herds referred to as "monitored", by
  1 23 reducing the amount of time between testing, conducted by
  1 24 statistical sampling.  The interval for testing was reduced
  1 25 from every 12 months to every six months (see Iowa
  1 26 Administrative Code 21-64.156).
  1 27    The bill amends Code section 166D.7, which provides for the
  1 28 certification of noninfected herds as monitored herds.  The
  1 29 bill provides that in order to be certified as a monitored
  1 30 herd, the statistical sampling must be conducted at 12-month
  1 31 intervals, unless the department determines that a herd is
  1 32 located within an area where a high incidence of infection
  1 33 requires that statistical sampling occur more frequently.
