Section 483A.7, subsection 3, Code 2001, is 3 3 amended to read as follows: 3 4 3. A nonresident wild turkey hunter is required to have 3 5 only a nonresident wild turkey hunting license and pay the 3 6 wildlife habitat fee. The commission shall annually limit to 3 7twothree thousand licenses the number of nonresidents allowed 3 8 to have wild turkey hunting licenses. The number of 3 9 nonresident wild turkey hunting licenses shall be determined 3 10 as provided in section 481A.38. If a license cannot be 3 11 issued, the applicable fees, excluding an application fee of 3 12 twenty-five dollars, shall be returned to the applicant. The 3 13 commission shall allocate the nonresident wild turkey hunting 3 14 licenses issued among the zones based on the populations of 3 15 wild turkey. A nonresident applying for a wild turkey hunting 3 16 license must exhibit proof of having successfully completed a 3 17 hunter safety and ethics education program as provided in 3 18 section 483A.27 or its equivalent as determined by the 3 19 department before the license is issued. 3 20 Sec. 3. Section 483A.8, subsection 3, Code 2001, is 3 21 amended to read as follows: 3 22 3. A nonresident hunting deer is required to have a 3 23 nonresident deer license and must pay the wildlife habitat 3 24 fee. The commission shall annually limit toseventen 3 25 thousandfive hundredlicenses the number of nonresidents 3 26 allowed to have deer hunting licenses.Of the first six3 27thousand nonresident deer licenses issued, not more than3 28thirty-five percent of the licenses shall be bow season3 29licenses and, after the first six thousand nonresident deer3 30licenses have been issued, all additional licenses shall be3 31issued for antlerless deer only.The number of nonresident 3 32 deer hunting licenses shall be determined as provided in 3 33 section 481A.38. The commission shall allocate the 3 34 nonresident deer hunting licenses issued among the zones based 3 35 on the populations of deer. However, a nonresident applicant 4 1 may request one or more hunting zones, in order of preference, 4 2 in which the applicant wishes to hunt. Ifthe requesta 4 3 license cannot befulfilledissued, the applicable fees, 4 4 excluding an application fee of twenty-five dollars, shall be 4 5 returned to the applicant. A nonresident applying for a deer 4 6 hunting license must exhibit proof of having successfully 4 7 completed a hunter safety and ethics education program as 4 8 provided in section 483A.27 or its equivalent as determined by 4 9 the department before the license is issued. 4 10 Sec. 4. Section 483A.24, subsection 2, paragraph b, Code 4 11 2001, is amended to read as follows: 4 12 b. Uponwrittenapplicationon forms furnishedpursuant to 4 13 rules established by the department, the department shall 4 14 issue annually without fee one deer or one wild turkey 4 15 license, or both, to the owner of a farm unit or to a member 4 16 of the owner's family, but not to both, and to the tenant or 4 17 to a member of the tenant's family, but not to both. The deer 4 18 hunting license or wild turkey hunting license issued shall be 4 19 valid only on the farm unit for which an applicant qualifies 4 20 pursuant to this subsection and shall be equivalent to the 4 21 least restrictive license issued under section 481A.38. The 4 22 owner or the tenant need not reside on the farm unit to 4 23 qualify for a free license to hunt on that farm unit. A free 4 24 deer hunting license issued pursuant to this subsection shall 4 25 be valid during all shotgun deer seasons. 4 26 Sec. 5. Section 483A.24, subsection 2, paragraph c, Code 4 27 2001, is amended to read as follows: 4 28 c. In addition to the free deer hunting license received, 4 29 an owner of a farm unit or a member of the owner's family and 4 30 the tenant or a member of the tenant's family may purchase a 4 31 deer hunting license for any option offered to paying deer 4 32 hunting licensees. An owner of a farm unit or a member of the 4 33 owner's family and the tenant or a member of the tenant's 4 34 family may also purchase two additional anterless deer hunting 4 35 licenses which are valid only on the farm unit for a fee of 5 1 ten dollars each. 5 2 Sec. 6. Section 483A.24, subsection 2, Code 2001, is 5 3 amended by adding the following new paragraph: 5 4 NEW PARAGRAPH. e. Upon application pursuant to rules 5 5 established by the department and payment of a nonresident 5 6 deer hunting license fee, the department shall issue a deer 5 7 hunting license to the nonresident owner or owners of a farm 5 8 unit. In addition to the application and payment of the 5 9 license fee, the nonresident owner or owners of a farm unit 5 10 shall prepare and adhere to a deer population management plan 5 11 approved pursuant to rules of the department. The primary 5 12 objective of a deer population management plan is to manage 5 13 deer populations to minimize damage to agricultural crops on 5 14 adjacent land. The deer hunting license issued shall be valid 5 15 only on the farm unit for which the applicant qualifies 5 16 pursuant to this subsection and shall be equivalent to the 5 17 least restrictive license issued under section 481A.38. The 5 18 nonresident deer hunting licenses issued pursuant to this 5 19 paragraph shall be in addition to the number of nonresident 5 20 hunting licenses authorized pursuant to section 483A.8. 5 21 Sec. 7. EFFECTIVE AND APPLICABILITY DATES. Sections 1, 2, 5 22 3, and 6 of this Act take effect December 15, 2001, and apply 5 23 to licenses and fees for wildlife and game activities for the 5 24 years beginning on or after January 1, 2002. 5 25 EXPLANATION 5 26 This bill amends sections of the Code relating to the 5 27 regulation of fish and game. 5 28 The bill also increases the fees for hunting, fishing, and 5 29 fur harvesting, except lifetime licenses for residents, by 5 30 amounts ranging from $.50 to 74.50. Two new fees of $38.00 5 31 for a deer and turkey combination bow and arrow license and of 5 32 $16.00 for a resident antlerless only deer license are added. 5 33 Also, the resident and nonresident seven-day fishing licenses 5 34 are separated and the fee is increased to $12.00 for a 5 35 resident license and to $27.00 for a nonresident license. 6 1 The number of annual nonresident wild turkey licenses is 6 2 increased from 2,000 to 3,000 and the annual nonresident deer 6 3 hunting license is increased from 7,500 to 10,000. In 6 4 addition, a $25 nonrefundable application fee is included in 6 5 each nonresident wild turkey or deer license fee. 6 6 The bill also authorizes a resident owner of a farm unit or 6 7 member of the owner's family and the tenant or a member of the 6 8 tenants family to purchase two additional anterless only deer 6 9 hunting licenses which are valid only on the farm unit. These 6 10 licenses are in addition to the free deer hunting license. 6 11 For nonresident owners of a farm unit a nonresident deer 6 12 hunting license may be purchased if the nonresident owner 6 13 prepares and adheres to a deer population management plan 6 14 approved by the department. The primary objective of the 6 15 management plan is to manage deer populations to minimize 6 16 damage to agricultural crops on adjacent land. The 6 17 nonresident deer hunting licenses are not subject to the 6 18 overall 10,000 nonresident license limit. 6 19 Sections 1, 2, 3, and 6 of the bill take effect December 6 20 15, 2001, and apply to licenses and fees for wildlife and game 6 21 activities for the years beginning on or after January 1, 6 22 2002. 6 23 LSB 1191SV 79 6 24 tj/cf/24
