1 1 Section 1. Section 56.5A, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3. a. A candidate's committee shall not
1 4 accept contributions from sources other than eligible electors
1 5 within the district represented by the office to which the
1 6 candidate presently seeks election, unless the candidate's
1 7 committee has received and deposited in the candidate's
1 8 campaign account an equal or greater total of contributions
1 9 from eligible electors within the district represented by the
1 10 office to which the candidate presently seeks election.
1 11 b. A candidate who accepts a contribution in violation of
1 12 this subsection shall be fined civilly in an amount equal to
1 13 ten times the amount by which the contribution exceeded the
1 14 permitted limit. The fine proceeds shall be deposited in the
1 15 Iowa election campaign fund created in section 56.19.
1 16 EXPLANATION
1 17 This bill amends Code chapter 56 to restrict a candidate's
1 18 committee in its acceptance of contributions from sources
1 19 other than eligible electors within the candidate's district.
1 20 A candidate could accept funds from such sources only up to
1 21 the amount of funds that the candidate has collected from
1 22 eligible electors within the candidate's district.
1 23 The penalty for violation of this limitation would be a
1 24 civil fine equal to 10 times the amount accepted in excess of
1 25 the limit.
1 26 Pursuant to Code section 68B.32D, the fine could be imposed
1 27 by the ethics and campaign disclosure board if it were no more
1 28 than $2,000.
