  1  4 PROHIBITING THE INSTALLATION, DISTRIBUTION, OR SALE OF
  1  5    NONOPERATIVE AIR BAGS AND PROVIDING A PENALTY.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  NEW SECTION.  321.71A  NONOPERATIVE AIR BAGS.
  1 11    A person shall not install or reinstall for compensation,
  1 12 distribute, or sell a nonoperative air bag that is part of an
  1 13 inflatable restraint system for a motor vehicle if the person
  1 14 knows that the air bag is nonoperative.  A violation of this
  1 15 section is an aggravated misdemeanor punishable by confinement
  1 16 for up to one year and a fine of at least five hundred dollars
  1 17 but not more than five thousand dollars.
  1 18    For purposes of this section, "nonoperative air bag"
  1 19 includes an air bag that has been previously deployed, is
  1 20 nonfunctional, or is otherwise defective.  "Nonoperative air
  1 21 bag" also includes anything that is inserted, or is intended
  1 22 to be inserted, in place of an airbag, which would prohibit an
  1 23 inflatable restraint system from functioning properly.
