  1  1    Section 1.  Section 322F.1, subsections 1 and 3, Code 2001,
  1  2 are amended to read as follows:
  1  3    1.  "Dealer" or "dealership" means a person engaged in the
  1  4 retail sale of equipment, if the person sells equipment
  1  5 designed to be principally used for agricultural or
  1  6 horticultural operations, lawn, garden, golf course,
  1  7 landscaping, or grounds maintenance purposes, or raising
  1  8 livestock.
  1  9    3.  "Equipment" means a device or part of a device designed
  1 10 to be used for agriculture, horticulture, lawn, garden, golf
  1 11 course, landscaping, or grounds maintenance purposes, or
  1 12 livestock raising.  Equipment includes but is not limited to
  1 13 tractors, trailers, combines, tillage, planting, and
  1 14 cultivating implements, balers, and irrigation implements, and
  1 15 machinery, equipment, or repair parts used for lawn, garden,
  1 16 golf course, landscaping, or grounds maintenance purposes.
  1 17 Equipment also includes attachments to equipment.  Equipment
  1 18 does not include self-propelled machines designed primarily
  1 19 for the transportation of persons or property on a street or
  1 20 highway.  
  1 21                           EXPLANATION
  1 22    This bill amends Code chapter 322F to provide that dealers
  1 23 of lawn, garden, golf course, landscaping, or grounds
  1 24 maintenance equipment are treated the same as dealers of farm
  1 25 equipment for the purposes of triggering the buyback
  1 26 provisions of parts and equipment if a dealership agreement is
  1 27 terminated as well as the other provisions contained in Code
  1 28 chapter 322F concerning equipment dealership agreements.
