1 1 Section 1. NEW SECTION. 7D.10B PSEUDORABIES VACCINE
1 2 EXPENSES.
1 3 If sufficient moneys for costs have not been appropriated
1 4 to the department of agriculture and land stewardship for the
1 5 purchase of laboratory products used for vaccinating swine as
1 6 required under section 166D.11, or if sufficient funds are not
1 7 otherwise available for such purposes within the budget of the
1 8 department, the executive council may upon request of the
1 9 secretary of agriculture pay, out of any money in the state
1 10 treasury not otherwise appropriated, expenses incurred, or
1 11 costs taxed to the state, as provided in section 7D.29.
1 12 Sec. 2. Section 166D.11, subsection 4, Code 2001, is
1 13 amended to read as follows:
1 14 4. a. The cost, or any segment of the cost, of purchasing
1 15 a laboratory product used for testing and vaccination provided
1 16 in this chapter may be paid for by federal or state funds or a
1 17 combination of both.
1 18 b. To the extent that federal funds are not available to
1 19 pay for the purchase of laboratory products used for
1 20 vaccinating swine as required under this chapter, the state
1 21 shall pay for the laboratory products, if any of the following
1 22 apply:
1 23 (1) The swine reacts negatively to a test within forty-
1 24 eight hours prior to the vaccination.
1 25 (2) The swine is from a noninfected herd and a statistical
1 26 sampling of the herd reacts negatively to a test conducted six
1 27 months prior to the vaccination.
1 28 An owner of swine shall not be paid more than seven
1 29 thousand five hundred dollars under this paragraph "b".
1 30 The cost of laboratory products used for vaccinating swine
1 31 as provided in this paragraph "b" shall be paid by the
1 32 department of agriculture and land stewardship from moneys
1 33 appropriated for that purpose or from moneys available to the
1 34 executive council pursuant to section 7D.10B.
1 35 c. Federal or state funds shall not be paid to the owner
2 1 of a vaccinated herd other than the owner of a herd vaccinated
2 2 with a modified-live differentiable vaccine.
2 3 EXPLANATION
2 4 This bill amends Code chapter 166D, which regulates
2 5 pseudorabies, a disease affecting swine. The department of
2 6 agriculture and land stewardship administers the provisions
2 7 under the chapter and regulations promulgated by the United
2 8 States department of agriculture referred to as the national
2 9 pseudorabies eradication program. In 2000, the general
2 10 assembly enacted Senate File 2312 (2000 Iowa Acts, chapter
2 11 1110) that imposed new requirements, including additional
2 12 vaccination requirements.
2 13 Code section 166D.11 provides that the cost or any segment
2 14 of the cost of purchasing a laboratory product used for
2 15 testing and vaccination may be paid for by federal or state
2 16 funds. The bill amends that section by providing that if
2 17 federal funds are not available to pay for the purchase of
2 18 laboratory products used for vaccination, the department of
2 19 agriculture and land stewardship is required to pay for the
2 20 laboratory products if moneys are appropriated for that
2 21 purpose. If moneys are not appropriated, the executive
2 22 council is authorized to make the payments.
2 23 The swine must react negatively to a pseudorabies test
2 24 within 48 hours prior to the vaccination, or the swine must be
2 25 from a noninfected herd and a statistical sampling of the herd
2 26 must react negatively to a test conducted six months prior to
2 27 the vaccination. In any case, federal or state funds cannot
2 28 be used to pay for a vaccine, unless it is a modified-live
2 29 differentiable vaccine.
