PAG LIN 1 1 SENATE FILE 98 1 2 1 3 AN ACT 1 4 CONCERNING UNEMPLOYMENT COMPENSATION BY RELIEVING UNEMPLOYMENT 1 5 COMPENSATION CHARGES FOR EMPLOYEES WHO BECOME UNEMPLOYED DUE 1 6 TO A PRESIDENTIALLY DECLARED DISASTER AND PROVIDING EFFECTIVE 1 7 AND RETROACTIVE APPLICABILITY DATES. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 96.7, subsection 2, paragraph a, 1 12 subparagraph (2), Code 2001, is amended by adding the 1 13 following new unnumbered paragraph: 1 14 NEW UNNUMBERED PARAGRAPH. The account of an employer shall 1 15 not be charged with benefits paid to an individual for 1 16 unemployment that is directly caused by a major natural 1 17 disaster declared by the president of the United States, 1 18 pursuant to the federal Disaster Relief Act of 1974, if the 1 19 individual would have been eligible for federal disaster 1 20 unemployment assistance benefits with respect to that 1 21 unemployment but for the individual's receipt of regular 1 22 benefits. 1 23 Sec. 2. EFFECTIVE AND RETROACTIVE APPLICABILITY DATES. 1 24 This Act, being deemed of immediate importance, takes effect 1 25 upon enactment, and applies retroactively to January 1, 2001, 1 26 to employer accounts for benefits paid to individuals as 1 27 provided in section 1 of this Act. 1 28 1 29 1 30 1 31 MARY E.
