PAG LIN 1 1 Section 1. Section 217.30, subsection 2, Code 2001, is 1 2 amended to read as follows: 1 3 2. Information described in subsection 1 shall not be 1 4 disclosed to or used by any person or agency except for 1 5 purposes of administration of the programs of services or 1 6 assistance, and shall not in any case, except as otherwise 1 7 provided in subsection 4,paragraph "b",be disclosed to or 1 8 used by persons or agencies outside the department unless they 1 9 are subject to standards of confidentiality comparable to 1 10 those imposed on the department by this division. 1 11 Sec. 2. Section 217.30, subsection 4, Code 2001, is 1 12 amended by adding the following new paragraph: 1 13 NEW PARAGRAPH. e. Any confidential information described 1 14 in subsection 1 that is available to the individual receiving 1 15 services or assistance shall be disclosed to that individual's 1 16 court-appointed legal guardian. 1 17 EXPLANATION 1 18 This bill authorizes disclosure of certain information to 1 19 the legal guardian of an individual receiving assistance or 1 20 services from the department of human services. 1 21 The bill amends Code section 217.30, relating to 1 22 confidentiality of the department's records. Code section 1 23 217.30 is amended to require that any confidential information 1 24 that is available to the individual receiving assistance or 1 25 services shall be disclosed to that individual's court- 1 26 appointed guardian. A subsection of that Code section is also 1 27 amended to broaden an internal reference. 1 28 LSB 1280SS 79 1 29 jp/cf/24
