  1  1    Section 1.  Section 331.301, subsection 15, paragraph a,
  1  2 unnumbered paragraph 1, Code 2001, is amended to read as
  1  3 follows:
  1  4    A county may adopt and enforce an ordinance requiring the
  1  5 construction of a storm shelter at a mobile home park which is
  1  6 constructed after July 1, 1999.  In lieu of requiring
  1  7 construction of If a storm shelter is not required at a mobile
  1  8 home park, a county may shall require a park owner to provide
  1  9 a plan for the evacuation of park residents to a safe place of
  1 10 shelter in times of severe weather including tornadoes and
  1 11 high winds if the county determines that a safe place of
  1 12 shelter is available within a reasonable distance of the
  1 13 mobile home park for use by park residents.  Each evacuation
  1 14 plan prepared pursuant to this subsection shall be filed with,
  1 15 and approved by, the local emergency management agency.  If
  1 16 construction of a storm shelter is required, an ordinance
  1 17 adopted or enforced pursuant to this subsection shall not
  1 18 include any of the following requirements:
  1 19    Sec. 2.  Section 331.301, subsection 15, paragraph a,
  1 20 subparagraph (3), Code 2001, is amended to read as follows:
  1 21    (3)  That the storm shelter exceed the construction
  1 22 specifications approved by a licensed professional engineer
  1 23 and presented by the owner of the mobile home park local
  1 24 emergency management agency.
  1 25    Sec. 3.  Section 364.3, subsection 8, paragraph a,
  1 26 unnumbered paragraph 1, Code 2001, is amended to read as
  1 27 follows:
  1 28    A city may adopt and enforce an ordinance requiring the
  1 29 construction of a storm shelter at a mobile home park which is
  1 30 constructed after July 1, 1999.  In lieu of requiring
  1 31 construction of If a storm shelter is not required at a mobile
  1 32 home park, a city may shall require a park owner to provide a

  2  8    Sec. 4.  Section 364.3, subsection 8, paragraph a,
  2  9 subparagraph (3), Code 2001, is amended to read as follows:
  2 10    (3)  That the storm shelter exceed the construction
  2 11 specifications approved by a licensed professional engineer
  2 12 and presented by the owner of the mobile home park local
  2 13 emergency management agency.  
  2 14                           EXPLANATION
  2 15    This bill provides that a county or a city may adopt and
  2 16 enforce an ordinance requiring the construction of a storm
  2 17 shelter at a mobile home park.  Currently, such a county or
  2 18 city ordinance applies only to mobile home parks constructed
  2 19 after July 1, 1999.  If a storm shelter is required, the
  2 20 construction specifications of the storm shelter need not
  2 21 exceed those specifications approved by a licensed
  2 22 professional engineer and the local emergency management
  2 23 agency.
  2 24    If a storm shelter is not required at a mobile home park, a
  2 25 county or city shall require a mobile home park owner to
  2 26 provide a plan for the evacuation of park residents to a safe
  2 27 place of shelter in times of severe weather.  The evacuation
  2 28 plan shall be filed with, and approved by, the local emergency
  2 29 management agency.
