1 3 A Concurrent Resolution to request a legislative interim
1 4 study committee on condemnation of land in Iowa.
1 5 WHEREAS, private property rights is an important
1 6 and long-standing value of Iowans; and
1 7 WHEREAS, the ability to take land needed for a
1 8 public purpose is a vital right of government and
1 9 those entities authorized by government to take land
1 10 for a public purpose; and
1 11 WHEREAS, the taking of private property by
1 12 government and other entities is a traumatic
1 13 experience for the landowner; and
1 14 WHEREAS, the taking of land by government or other
1 15 authorized entities, by its extreme nature, requires
1 16 proper compensation and adequate notice; NOW
1 17 THEREFORE,
1 18 BE IT RESOLVED BY THE SENATE, THE HOUSE OF
1 19 REPRESENTATIVES CONCURRING, That the legislative
1 20 council is requested to establish an interim study
1 21 committee, for the 2002 legislative interim, to study
1 22 condemnation of land in Iowa. The committee shall
1 23 study the current process for condemnation of land,
1 24 including, but not limited to, entities authorized to
1 25 initiate condemnation proceedings, allowable purposes
1 26 for condemnation, notice requirements, the process for
1 27 appraisement of damages, the rights of appeal in a
1 28 condemnation proceeding, the payment of damages
1 29 awarded by the compensation commission and interest
1 30 paid on damages, the time allowed by law to collect a
2 1 condemnation award and the time allowed by law to take
2 2 possession of land condemned, and the separate
2 3 condemnation processes for utilities and the state
2 4 department of transportation.
