Section 455G.3, Code Supplement 2001, is 3 8 amended by adding the following new subsections: 3 9 NEW SUBSECTION. 7. There is appropriated from the 3 10 funds administered by the board to the following funds 3 11 for the fiscal year beginning July 1, 2002, and ending 3 12 June 30, 2003, the following amounts as specified: 3 13 a. To the rebuild Iowa infrastructure fund: 3 14 .................................................. $ 9,370,600 3 15 b. To the environment first fund: 3 16 .................................................. $ 10,000,000 3 17 c. To the general fund of the state: 3 18 .................................................. $ 19,225,071 3 19 This subsection is repealed effective July 1, 2004. 3 20 NEW SUBSECTION. 8. Notwithstanding other 3 21 limitations of this chapter, the board may transfer 3 22 moneys without limitation between the different 3 23 accounts and funds authorized by this chapter as 3 24 determined by the board and to fulfill the purposes of 3 25 this chapter. This subsection is repealed effective 3 26 July 1, 2004. 3 27 Sec. ___. Section 455G.6, Code 2001, is amended by 3 28 adding the following new subsection: 3 29 NEW SUBSECTION. 17. Not later than October 31, 3 30 2002, the board shall enter into a loss portfolio 3 31 transfer agreement, to be implemented not later than 3 32 December 31, 2002, with the restructured insurance 3 33 board authorized in section 455G.11, subsection 1, 3 34 paragraph "c", for the payment of claims for 3 35 corrective action associated with releases at sites 3 36 which are insured at the time of the transfer by the 3 37 restructured insurance board subject to the following 3 38 conditions: 3 39 a. The value of the transfer shall be determined 3 40 by mutual agreement of persons representing the board, 3 41 the restructured insurance board authorized in section 3 42 455G.11, subsection 1, paragraph "c", and a third 3 43 party designated and agreed to by the board and the 3 44 restructured insurance board. The amount transferred 3 45 shall be adequate to address all claim costs for 3 46 corrective action, fees, taxes, risk costs incurred by 3 47 the transferee, administration expenses associated 3 48 with the transferred claims, and other costs as 3 49 mutually agreed to by the parties. 3 50 b. The transfer shall address payments to eligible 4 1 claimants as determined by the board prior to the 4 2 transfer. 4 3 c. The transfer shall coincide with the transfer 4 4 of liabilities subject to the following, unless the 4 5 parties mutually agree otherwise: 4 6 (1) The lesser of twenty-five percent of the 4 7 agreed upon value or twenty million dollars, to be 4 8 transferred at the time of implementation of the 4 9 agreement, but not later than December 31, 2002, 4 10 unless another date is mutually agreed to by the 4 11 parties. 4 12 (2) Fifty percent of the remaining amount to be 4 13 transferred by July 1, 2003. 4 14 (3) Any remaining amount to be transferred by July 4 15 1, 2004. 4 16 d. The transferee shall be responsible for all 4 17 claim costs for corrective action, fees, and taxes 4 18 associated with each claim transferred. 4 19 e. Claims for releases at sites that are not 4 20 insured by the transferee may be included in the 4 21 agreement entered into pursuant to this subsection or 4 22 subsequent agreements if agreed to by the board and 4 23 the restructured insurance board. 4 24 Sec. .
