  1  1    Amend House File 2623, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 12, by inserting after line 21 the
  1  4 following:
  1  5    "Sec.    .  Section 15A.1, Code Supplement 2001, is
  1  6 amended by adding the following new subsection:
  1  7    NEW SUBSECTION.  6.  In addition to the
  1  8 requirements of subsections 2 and 3, a state agency
  1  9 shall not provide a grant, loan, or other financial
  1 10 assistance to a private person or on behalf of a
  1 11 private person unless the business for whose benefit
  1 12 the financial assistance is to be provided pays at
  1 13 minimum a living wage to its employees.  For purposes
  1 14 of this subsection, "living wage" means an hourly wage
  1 15 of no less than the annualized federal poverty level
  1 16 for a family of four, as defined by the most recently
  1 17 revised poverty income guidelines as published by the
  1 18 United States department of health and human services,
  1 19 divided by two thousand eighty.  If any provision of
  1 20 this subsection that relates to a living wage paid by
  1 21 a business applying for or receiving state financial
  1 22 assistance is inconsistent or conflicts with other
  1 23 provisions of chapter 15 or this chapter, the
  1 24 provision that specifies the higher wage rate
  1 25 prevails."
  1 26    #2.  Page 13, by inserting after line 17 the
  1 27 following:
  1 28    "Sec.    .  Section 91D.1, subsection 1, paragraphs
  1 29 a and d, Code 2001, are amended to read as follows:
  1 30    a.  The hourly wage stated in the federal minimum
  1 31 wage law, pursuant to 29 U.S.C. } 206, shall be
  1 32 increased to $3.85 $5.65 on January 1, of 1990, 2003,
  1 33 $4.25 on January 1 of 1991, and $4.65 to $6.15 on
  1 34 January 1, of 1992 2004.
  1 35    d.  An employer is not required to pay an employee
  1 36 the applicable minimum wage provided in paragraph "a"
  1 37 until the employee has completed ninety calendar days
  1 38 of employment with the employer.  An employee who has
  1 39 completed ninety calendar days of employment with the
  1 40 employer prior to January 1, of 1990 2003, 1991, or
  1 41 1992 January 1, 2004, shall earn the applicable hourly
  1 42 minimum wage.  An employer shall pay an employee who
  1 43 has not completed ninety calendar days of employment
  1 44 with the employer an hourly wage of at least $3.35
  1 45 $5.15 as of January 1, of 1990 2003, $3.85 as of
  1 46 January 1 of 1991, and $4.25 $5.65 as of January 1, of
  1 47 1992 2004."
