  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 40, by inserting after line 48 the
  1  4 following:
  1  5    "Sec.    .  NEW SECTION.  455B.205B  MORATORIUM –
  1  6 CONSTRUCTION OF CONFINEMENT FEEDING OPERATION
  1  7 STRUCTURES.
  1  8    1.  Except as provided in subsection 2, all of the
  1  9 following shall apply:
  1 10    a.  A person shall not construct, including expand,
  1 11 a confinement feeding operation structure.
  1 12    b.  The department shall not issue a permit as
  1 13 otherwise provided in section 455B.200A for the
  1 14 construction, including expansion, of a confinement
  1 15 feeding operation structure.
  1 16    2.  Subsection 2 does not apply to any of the
  1 17 following:
  1 18    a.  Construction of a confinement feeding operation
  1 19 structure, if after construction the confinement
  1 20 feeding operation is a small animal feeding operation.
  1 21    b.  Construction of a confinement feeding operation
  1 22 structure that does not increase the maximum animal
  1 23 unit capacity of the confinement feeding operation.
  1 24    c.  Construction that is ordered by the department
  1 25 in order to remedy a clear, present, and impending
  1 26 danger to the public health or the environment.
  1 27    d.  Construction of a confinement feeding operation
  1 28 structure that begins prior to the enactment of this
  1 29 Act.
  1 30    3.  This section is repealed on July 1, 2003."
  1 31    #2.  By renumbering as necessary.
