1 3 #1. Page 5, by inserting after line 21, the
1 4 following:
1 5 "Sec. . Section 321.236, subsection 1,
1 6 paragraph a, Code Supplement 2001, is amended to read
1 7 as follows:
1 8 a. May be charged and collected upon a simple
1 9 notice of a fine payable to the city clerk or clerk of
1 10 the district court, if authorized by ordinance. The
1 11 fine shall not exceed five dollars except for snow
1 12 route parking violations in which case the fine shall
1 13 not exceed twenty-five dollars. The fine may be
1 14 increased up to ten dollars if the parking violation
1 15 is not paid within thirty days of the date upon which
1 16 the violation occurred, if authorized by ordinance.
1 17 Violations of section 321L.4, subsection 2, may be
1 18 charged and collected upon a simple notice of a one
1 19 hundred dollar fine payable to the city clerk or clerk
1 20 of the district court, if authorized by ordinance. No
1 21 costs or other charges shall be assessed, except a
1 22 local public transit surcharge of up to one dollar if
1 23 the local authority has adopted an ordinance pursuant
1 24 to section 364.3, subsection 2, paragraph "b". All
1 25 fines collected by a city pursuant to this paragraph
1 26 shall be retained by the city and all fines collected
1 27 by a county pursuant to this paragraph shall be
1 28 retained by the county.
1 29 Sec. . Section 364.3, subsection 2, Code
1 30 Supplement 2001, is amended to read as follows:
1 31 2. a. A city shall not provide a penalty in
1 32 excess of a five hundred dollar fine or in excess of
1 33 thirty days imprisonment for the violation of an
1 34 ordinance. An amount equal to ten percent of all
1 35 fines collected by cities shall be deposited in the
1 36 account established in section 602.8108. However, one
1 37 hundred percent of all fines collected by a city
1 38 pursuant to section 321.236, subsection 1, shall be
1 39 retained by the city. The criminal penalty surcharge
1 40 required by section 911.2 shall be added to a city
1 41 fine and is not a part of the city's penalty.
1 42 b. A city may adopt an ordinance to assess a local
1 43 public transit surcharge of up to one dollar to be
1 44 added to city fines for parking violations. Moneys
1 45 collected from the surcharge shall be retained by the
1 46 city and kept in a separate account to be used only
1 47 for establishing, improving, or maintaining public
1 48 transit within the city or surrounding area."
1 49 #2. Title page, line 5, by inserting after the
1 50 words "the state," the following: "relating to a
2 1 local transit surcharge for parking violations,".
2 2 #3. By renumbering, redesignating, and correcting
2 3 internal references as necessary.
