1 49 The university may continue progress on the school
1 50 of public health and the public health initiative for
2 1 the purposes of establishing an accredited school of

2 5 university may use up to $2,100,000 for the school of
2 6 public health and the public health initiative.
2 7 Funds appropriated in this lettered paragraph shall
2 8 not be available for expenditure for medically induced
2 9 termination of a pregnancy, including but not limited
2 10 to usage of mifepristone or RU-486, offered or
2 11 administered by the student health center.
2 12 b. University hospitals
2 13 For salaries, support, maintenance, equipment, and
2 14 miscellaneous purposes and for medical and surgical
2 15 treatment of indigent patients as provided in chapter
2 16 255, for medical education, and for not more than the
2 17 following full-time equivalent positions:

2 20 The university of Iowa hospitals and clinics shall,
2 21 within the context of chapter 255 and when medically
2 22 appropriate, make reasonable efforts to extend the
2 23 university of Iowa hospitals and clinics' use of home
2 24 telemedicine and other technologies to reduce the
2 25 frequency of visits to the hospital required by
2 26 indigent patients. The university of Iowa hospitals
2 27 and clinics shall submit a report to the general
2 28 assembly and the legislative fiscal bureau by January
2 29 15, 2003, describing its use of these technologies to
2 30 accomplish this purpose.
2 31 The university of Iowa hospitals and clinics shall
2 32 submit quarterly a report regarding the portion of the
2 33 appropriation in this lettered paragraph expended on
2 34 medical education. The report shall be submitted in a
2 35 format jointly developed by the university of Iowa
2 36 hospitals and clinics, the legislative fiscal bureau,
2 37 and the department of management, and shall delineate
2 38 the expenditures and purposes of the funds.
2 39 Funds appropriated in this lettered paragraph shall
2 40 not be used to perform abortions except medically
2 41 necessary abortions, and shall not be used to operate
2 42 the early termination of pregnancy clinic except for
2 43 the performance of medically necessary abortions. For
2 44 the purpose of this lettered paragraph, an abortion is
2 45 the purposeful interruption of pregnancy with the
2 46 intention other than to produce a live-born infant or
2 47 to remove a dead fetus, and a medically necessary
2 48 abortion is one performed under one of the following
2 49 conditions:
2 50 (1) The attending physician certifies that
3 1 continuing the pregnancy would endanger the life of
3 2 the pregnant woman.
3 3 (2) The attending physician certifies that the
3 4 fetus is physically deformed, mentally deficient, or
3 5 afflicted with a congenital illness.
3 6 (3) The pregnancy is the result of a rape which is
3 7 reported within 45 days of the incident to a law
3 8 enforcement agency or public or private health agency
3 9 which may include a family physician.
3 10 (4) The pregnancy is the result of incest which is
3 11 reported within 150 days of the incident to a law
3 12 enforcement agency or public or private health agency
3 13 which may include a family physician.
3 14 (5) The abortion is a spontaneous abortion,
3 15 commonly known as a miscarriage, wherein not all of
3 16 the products of conception are expelled.
3 17 The total quota allocated to the counties for
3 18 indigent patients for the fiscal year beginning July
3 19 1, 2002, shall not be lower than the total quota
3 20 allocated to the counties for the fiscal year
3 21 commencing July 1, 1998. The total quota shall be
3 22 allocated among the counties on the basis of the 2000
3 23 census pursuant to section 255.16.

5 17 It is possible that a few large companies may be
5 18 able to control all levels of the food chain,
5 19 including production, because these companies own the
5 20 genetics needed to participate in the food system of
5 21 the future, and this possibility may be a major threat
5 22 to the independence and profitability of Iowa's
5 23 agricultural producers. To ensure public ownership of
5 24 plant genetic material, all rights to the research
5 25 products developed by the Iowa state university of
5 26 science and technology's botany institute using state-
5 27 appropriated funds will be made available to the
5 28 extent practicable for commercialization, for the
5 29 benefit of all Iowans, including Iowa's agricultural
5 30 producers, through a public process which normally
5 31 involves nonexclusive licensing of genes and
5 32 germplasm.
5 33 Funds appropriated in this lettered paragraph shall
5 34 not be available for expenditure for medically induced
5 35 termination of a pregnancy, including but not limited
5 36 to usage of mifepristone or RU-486, offered or
