1 1 Amend Senate File 2324 as follows:
1 2 #1. Page 4, by inserting after line 14 the
1 3 following:
1 4 "8. REMEDIES. In addition to any other available
1 5 remedy at law, a taxpayer or public owner may bring an
1 6 action against a construction manager that commits an
1 7 unlawful act under this section to recover either of
1 8 the following:
1 9 a. The amount of monies or property acquired by
1 10 the construction manager from the public owner by
1 11 committing an unlawful act under this section,
1 12 including reasonable costs and attorney fees incurred.
1 13 b. The amount of monies a losing bidder would have
1 14 received if the losing bidder had been awarded a
1 15 contract for services on a public works project that
1 16 was wrongfully awarded to another person due to an
1 17 unlawful act under this section committed by the
1 18 construction manager, including reasonable costs and
1 19 attorney fees incurred."
