1 1 Amend Senate File 2250 as follows:
1 2 #1. By striking page 1, line 10, through page 2,
1 3 line 11, and inserting the following:
1 4 "Sec. . Section 462A.12, subsection 6, Code
1 5 Supplement 2001, is amended by striking the subsection
1 6 and inserting in lieu thereof the following:
1 7 6. An owner or operator shall not permit any
1 8 person under twelve years of age to operate the
1 9 personal watercraft unless accompanied in or on the
1 10 same personal watercraft by a responsible person of at
1 11 least eighteen years of age. However, commencing
1 12 January 1, 2003, a person who is twelve years of age
1 13 or older but less than eighteen years of age shall not
1 14 operate any personal watercraft unless the person has
1 15 successfully completed a department-approved
1 16 watercraft safety course. A person required to have a
1 17 watercraft safety certificate shall carry and shall
1 18 exhibit or make available the certificate upon request
1 19 of an officer of the department. A violation of this
1 20 subsection is a simple misdemeanor as provided in
1 21 section 462A.13. However, a person charged with
1 22 violating this subsection shall not be convicted if
1 23 the person produces in court, within a reasonable
1 24 time, a department-approved certificate. The cost of
1 25 a department certificate, or any duplicate, shall not
1 26 exceed five dollars.
1 27 Sec. . Section 462A.12, Code Supplement 2001,
1 28 is amended by adding the following new subsections:
1 29 NEW SUBSECTION. 12. A person shall not operate a
1 30 personal watercraft at any time between sundown and
1 31 sunup.
1 32 NEW SUBSECTION. 13. A person shall not chase or
1 33 harass animals while operating a personal watercraft
1 34 or motorboat."
1 35 #2. Title page, line 2, by striking the words "or
1 36 motorboats".
1 37 #3. By renumbering as necessary.
