1 5 "Section 1. Section 476.1A, Code 2001, is amended
1 6 by adding the following new subsection:
1 7 NEW SUBSECTION. 5A. Filing alternate energy
1 8 purchase program plans with the board, and offering
1 9 such programs to customers, pursuant to section
1 10 476.47."

1 21 "Sec. . NEW SECTION. 476.47 ALTERNATE ENERGY
1 22 PURCHASE PROGRAMS.
1 23 1. Beginning January 1, 2004, all electric
1 24 utilities, whether or not rate-regulated under this
1 25 chapter, shall offer alternate energy purchase
1 26 programs to all customers, based on energy produced by
1 27 alternate energy production facilities in Iowa.
1 28 2. The board shall require electric utilities to
1 29 file plans for alternate energy purchase programs
1 30 offered pursuant to this section.
1 31 a. Rate-regulated electric utilities shall file
1 32 alternate energy purchase programs that allow
1 33 customers to contribute voluntarily to the development
1 34 of alternate energy in Iowa, and shall file tariffs as
1 35 required by the board by rule.
1 36 b. Electric utilities that are not rate-regulated
1 37 shall offer alternate energy purchase programs at
1 38 rates determined by their governing authority, and
1 39 shall file tariffs with the board for informational
1 40 purposes only.
1 41 3. The electric utility shall notify consumers of
1 42 its alternate energy purchase program and any proposed
1 43 modifications to such program at least sixty days
1 44 prior to implementation of the program or any
1 45 modification.
1 46 4. For purposes of this section, an electric
1 47 utility may purchase energy from an alternate energy
1 48 production facility located outside of Iowa under
1 49 either of the following circumstances:
1 50 a. The purchase is pursuant to a contract in
2 1 effect prior to July 1, 2001, and continues until the
2 2 expiration of the contract, including any options to
2 3 renew that are exercised by the electric utility.
2 4 b. The electric utility has a financial interest,
2 5 as of July 1, 2001, in the alternate energy production
2 6 facility that is located outside of Iowa.
2 7 5. This section shall not apply to non-rate-
2 8 regulated electric utilities physically located
2 9 outside of Iowa that serve Iowa customers."
2 10 #5. By renumbering, relettering, redesignating,
2 11 and correcting internal references as necessary.
