Section 476.44, subsection 2, Code 1 6 2001, is amended to read as follows: 1 7 2. a. An electric utility subject to this 1 8 division, except a utilitywhichthat elects rate 1 9 regulation pursuant to section 476.1A, shall not be 1 10 required to purchase, at any one time, more than its 1 11 scheduled percentage share ofone hundred five1 12megawatts of powerits Iowa retail load from 1 13 alternative energy production facilities or small 1 14 hydro facilities at the rates established pursuant to 1 15 section 476.43. The board shallallocate the one1 16hundred five megawattsmake the allocations based upon 1 17 each utility's percentage of the total Iowa retail 1 18 peak demand, fortheeach year beginning January 1, 1 191990,of all utilities subject to this section, based 1 20 on the following schedule: 1 21 (1) Until January 1, 2004, two percent. 1 22 (2) Beginning January 1, 2005, five percent. 1 23 (3) Beginning January 1, 2006, six percent. 1 24 (4) Beginning January 1, 2007, seven percent. 1 25 (5) Beginning January 1, 2008, eight percent. 1 26 (6) Beginning January 1, 2009, nine percent. 1 27 (7) Beginning January 1, 2010, ten percent. 1 28 b. If a utility undergoes reorganization as 1 29 defined in section 476.76, the board shall combine the 1 30 allocated purchases of power for each utility involved 1 31 in the reorganization. 1 32 c. Notwithstanding theone hundred five megawatt1 33 current applicable maximum, the board may increase the 1 34 amount of power that a utility is required to purchase 1 35 at the rates established pursuant to section 476.43 if 1 36 the board finds that a utility, including a 1 37 reorganized utility, exceeds its1990previous Iowa 1 38 retail peak demand level by twenty percent, and the 1 39 additional power the utility is required to purchase 1 40 will encourage the development of alternate energy 1 41 production facilities and small hydro facilities. The 1 42 increase shall not exceed the utility's increase in 1 43 peak demand multiplied by the ratio of the utility's 1 44 share of theone hundred five megawattcurrent 1 45 scheduled maximum to its1990Iowa retail peak demand. 1 46 d. At least five percent of an electric utility's 1 47 yearly scheduled allocation pursuant to the schedule 1 48 in paragraph "a" shall be derived from alternate 1 49 energy production facilities or small hydro facilities 1 50 with an electrical energy production capacity of three 2 1 megawatts or less, if available." 2 2 #2.
