  1  1    Amend Senate File 203, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Section 1.  Section 257.3, subsection 2, Code
  1  6 2001, is amended to read as follows:
  1  7    2.  TAX FOR REORGANIZED AND DISSOLVED DISTRICTS.
  1  8 Notwithstanding subsection 1, a reorganized school
  1  9 district shall cause a foundation property tax of four
  1 10 dollars and forty cents per thousand dollars of
  1 11 assessed valuation to be levied on all taxable
  1 12 property which, in the year preceding a
  1 13 reorganization, was within a school district affected
  1 14 by the reorganization as defined in section 275.1, or
  1 15 in the year preceding a dissolution was a part of a
  1 16 school district that dissolved if the dissolution
  1 17 proposal has been approved by the director of the
  1 18 department of education pursuant to section 275.55.
  1 19 In the year preceding the reorganization or
  1 20 dissolution, the school district affected by the
  1 21 reorganization or the school district that dissolved
  1 22 must have had a certified enrollment of fewer than six
  1 23 hundred in order for the four-dollar-and-forty-cent
  1 24 levy to apply.  In succeeding school years, the
  1 25 foundation property tax levy on that portion shall be
  1 26 increased twenty cents per year until it reaches the
  1 27 rate of to the rate of four dollars and ninety cents
  1 28 per thousand dollars of assessed valuation the first
  1 29 succeeding year, five dollars and fifteen cents per
  1 30 thousand dollars of assessed valuation the second
  1 31 succeeding year, and five dollars and forty cents per
  1 32 thousand dollars of assessed valuation the third
  1 33 succeeding year and each year thereafter.
  1 34    For purposes of this section, a reorganized school
  1 35 district is one which absorbed absorbs at least thirty
  1 36 percent of the enrollment of the school district
  1 37 affected by a reorganization or dissolved during a
  1 38 dissolution and in which action to bring about a
  1 39 reorganization or dissolution was initiated by a vote
  1 40 of the board of directors or jointly by the affected
  1 41 boards of directors prior to November 30, 1990, and
  1 42 the reorganization or dissolution takes is initiated
  1 43 by a vote of the board of directors or jointly by the
  1 44 affected boards of directors to take effect on or
  1 45 after July 1, 1991 2002, and on or before July 1, 1993
  1 46 2006.  Each district which initiated, by a vote of the
  1 47 board of directors or jointly by the affected boards,
  1 48 action to bring about a reorganization or dissolution
  1 49 by November 30, 1990 to take effect on or after July
  1 50 1, 2002, and on or before July 1, 2006, shall certify
  2  1 the date and the nature of the action taken to the
  2  2 department of education by September January 1, 1991
  2  3 of the year in which the reorganization or dissolution
  2  4 takes effect.
  2  5    A reorganized school district which meets the
  2  6 requirements of this section for reduced property tax
  2  7 rates, but failed to vote on reorganization or
  2  8 dissolution prior to November 30, 1990, and failed to
  2  9 certify such action to the department of education by
  2 10 September 1, 1991, shall cause to be levied a
  2 11 foundation property tax of four dollars and sixty
  2 12 cents per thousand dollars of assessed valuation on
  2 13 all eligible taxable property pursuant to this
  2 14 section.  In succeeding school years, the foundation
  2 15 property tax levy on that portion shall be increased
  2 16 twenty cents per year until it reaches the rate of
  2 17 five dollars and forty cents per thousand dollars of
  2 18 assessed valuation.
  2 19    The reduced property tax rates of reorganized
  2 20 school districts that met the requirements of section
  2 21 442.2, Code 1991, prior to July 1, 1991, shall
  2 22 continue to increase as provided in that section until
  2 23 they reach five dollars and forty cents.
  2 24    Sec. 2.  Section 257.3, subsection 3, Code 2001, is
  2 25 amended by striking the subsection.
  2 26    Sec. 3.  Section 257.3, subsection 4, Code 2001, is
  2 27 amended to read as follows:
  2 28    4.  RAILWAY CORPORATIONS.  For purposes of section
  2 29 257.1, the "amount per pupil of foundation property
  2 30 tax" does not include the tax levied under subsection
  2 31 1, 2, or 3 2 on the property of a railway corporation,
  2 32 or on its trustee if the corporation has been declared
  2 33 bankrupt or is in bankruptcy proceedings.
  2 34    Sec. 4.  Section 257.4, subsection 3, Code 2001, is
  2 35 amended to read as follows:
  2 36    3.  APPLICATION OF TAX.  No later than June 1 15 of
  2 37 each year, the department of management shall notify
  2 38 the county auditor of each county the amount, in
  2 39 dollars and cents per thousand dollars of assessed
  2 40 value, of the additional property tax levy in each
  2 41 school district in the county.  A county auditor shall
  2 42 spread the additional property tax levy for each
  2 43 school district in the county over all taxable
  2 44 property in the district.
  2 45    Sec. 5.  Section 257.11, subsection 2, paragraph c,
  2 46 Code 2001, is amended by striking the paragraph and
  2 47 inserting in lieu thereof the following:
  2 48    c.  Pupils attending class for all or a substantial
  2 49 portion of a school day pursuant to a whole grade
  2 50 sharing agreement executed under sections 282.10
  3  1 through 282.12 shall be eligible for supplementary
  3  2 weighting pursuant to this subsection as follows:
  3  3    (1)  A school district which was participating in a
  3  4 whole grade sharing arrangement during the budget year
  3  5 beginning July 1, 2001, and which adopts a resolution
  3  6 jointly with the other affected boards to study the
  3  7 question of undergoing a reorganization or dissolution
  3  8 to take effect on or before July 1, 2006, shall
  3  9 receive a weighting of one-tenth of the percentage of
  3 10 the pupil's school day during which the pupil attends
  3 11 classes in another district, attends classes taught by
  3 12 a teacher who is jointly employed under section
  3 13 280.15, or attends classes taught by a teacher who is
  3 14 employed by another school district.  A district shall
  3 15 be eligible for supplementary weighting pursuant to
  3 16 this subparagraph for a maximum of two years.  Receipt
  3 17 of supplementary weighting for a second year shall be
  3 18 conditioned upon submission of information resulting
  3 19 from the study to the school budget review committee
  3 20 indicating progress toward the objective of
  3 21 reorganization on or before July 1, 2006.
  3 22    (2)  A school district which was not participating
  3 23 in a whole grade sharing arrangement during the budget
  3 24 year beginning July 1, 2001, which executes a whole
  3 25 grade sharing agreement pursuant to sections 282.10
  3 26 through 282.12 for the budget year beginning July 1,
  3 27 2003, and which adopts a resolution jointly with the
  3 28 other affected boards to study the question of
  3 29 undergoing a reorganization or dissolution to take
  3 30 effect on or before July 1, 2006, shall receive a
  3 31 weighting of one-tenth of the percentage of the
  3 32 pupil's school day during which the pupil attends
  3 33 classes in another district, attends classes taught by
  3 34 a teacher who is jointly employed under section
  3 35 280.15, or attends classes taught by a teacher who is
  3 36 employed by another school district.  A district shall
  3 37 be eligible for supplementary weighting pursuant to
  3 38 this subparagraph for a maximum of three years.
  3 39 Receipt of supplementary weighting for a second and
  3 40 third year shall be conditioned upon submission of
  3 41 information resulting from the study to the school
  3 42 budget review committee indicating progress toward the
  3 43 objective of reorganization on or before July 1, 2006.
  3 44    Sec. 6.  Section 257.11, Code 2001, is amended by
  3 45 adding the following new subsection:
  3 46    NEW SUBSECTION.  4A.  REGIONAL ACADEMIES.
  3 47    a.  For the school budget year beginning July 1,
  3 48 2002, and succeeding budget years, in order to provide
  3 49 additional funds for school districts in which a
  3 50 regional academy is located, a supplementary weighting
  4  1 plan for determining enrollment is adopted.
  4  2    b.  A school district which establishes a regional
  4  3 academy shall be eligible to assign its resident
  4  4 pupils attending classes at the academy a weighting of
  4  5 one-tenth of the percentage of the pupil's school day
  4  6 during which the pupil attends classes at the regional
  4  7 academy.  For the purposes of this subsection,
  4  8 "regional academy" means an educational institution
  4  9 established by a school district to which multiple
  4 10 schools send pupils in grades seven through twelve.  A
  4 11 regional academy shall include in its curriculum
  4 12 advanced-level courses and may include in its
  4 13 curriculum vocational-technical programs.  The maximum
  4 14 amount of additional weighting for which a school
  4 15 district establishing a regional academy shall be
  4 16 eligible is an amount corresponding to fifteen
  4 17 additional pupils.
  4 18    Sec. 7.  NEW SECTION.  257.11A  SUPPLEMENTARY
  4 19 WEIGHTING AND SCHOOL REORGANIZATION.
  4 20    1.  In determining weighted enrollment under
  4 21 section 257.6, if the board of directors of a school
  4 22 district has approved a contract for sharing pursuant
  4 23 to section 257.11 and the school district has approved
  4 24 an action to bring about a reorganization to take
  4 25 effect on and after July 1, 2002, and on or before
  4 26 July 1, 2006, the reorganized school district shall
  4 27 include, for a period of three years following the
  4 28 effective date of the reorganization, additional
  4 29 pupils added by the application of the supplementary
  4 30 weighting plan, equal to the pupils added by the
  4 31 application of the supplementary weighting plan in the
  4 32 year preceding the reorganization.  For the purposes
  4 33 of this paragraph, the weighted enrollment for the
  4 34 period of three years following the effective date of
  4 35 reorganization shall include the supplementary
  4 36 weighting in the base year used for determining the
  4 37 combined district cost for the first year of the
  4 38 reorganization.  However, the weighting shall be
  4 39 reduced by the supplementary weighting added for a
  4 40 pupil whose residency is not within the reorganized
  4 41 district.
  4 42    2.  For purposes of this section, a reorganized
  4 43 district is one in which the reorganization was
  4 44 approved in an election pursuant to sections 275.18
  4 45 and 275.20 and takes effect on or after July 1, 2002,
  4 46 and on or before July 1, 2006.  Each district which
  4 47 initiates, by a vote of the board of directors or
  4 48 jointly by the affected boards, action to bring about
  4 49 a reorganization or dissolution to take effect on or
  4 50 after July 1, 2002, and on or before July 1, 2006,
  5  1 shall certify the date and the nature of the action
  5  2 taken to the department of education by January 1 of
  5  3 the year in which the reorganization or dissolution
  5  4 takes effect.
  5  5    3.  Notwithstanding subsection 1, a school district
  5  6 which was participating in a whole grade sharing
  5  7 arrangement during the budget year beginning July 1,
  5  8 2001, and which received a maximum of two years of
  5  9 supplementary weighting pursuant to section 257.11,
  5 10 subsection 2, paragraph "c", shall include additional
  5 11 pupils added by the application of the supplementary
  5 12 weighting plan, equal to the pupils added by the
  5 13 application of the supplementary weighting plan in the
  5 14 year preceding the reorganization, for a period of
  5 15 four years following the effective date of the
  5 16 reorganization.
  5 17    4.  A school district shall be eligible for a
  5 18 combined maximum total of six years of supplementary
  5 19 weighting under the provisions of this section and
  5 20 section 257.11, subsection 2, paragraph "c".
  5 21    Sec. 8.  Section 257.13, subsections 1 and 2, Code
  5 22 2001, are amended to read as follows:
  5 23    1.  For the school budget year beginning July 1,
  5 24 2000 2001, and succeeding budget years, if a
  5 25 district's actual enrollment for the budget year,
  5 26 determined under section 257.6, is greater than its
  5 27 budget enrollment for the budget year, the district
  5 28 shall be eligible to receive an on-time funding budget
  5 29 adjustment.  The adjustment shall be in an amount
  5 30 equal to fifty percent of the difference between the
  5 31 actual enrollment for the budget year and the budget
  5 32 enrollment for the budget year, multiplied by the
  5 33 district cost per pupil.
  5 34    2.  The board of directors of a school district
  5 35 that wishes to receive an on-time funding budget
  5 36 adjustment shall adopt a resolution to receive the
  5 37 adjustment and notify the school budget review
  5 38 committee by November 1, 2000 annually.  The school
  5 39 budget review committee shall establish a modified
  5 40 allowable growth in an amount determined pursuant to
  5 41 subsection 1.
  5 42    Sec. 9.  Section 257.14, subsection 1, Code 2001,
  5 43 is amended to read as follows:
  5 44    1.  For the budget year commencing July 1, 2000
  5 45 2001, if the department of management determines that
  5 46 the regular program district cost of a school district
  5 47 for a budget year is less than the total of the
  5 48 regular program district cost plus any adjustment
  5 49 added under this section for the base year for that
  5 50 school district, the school district shall be eligible
  6  1 to receive a budget adjustment for that district for
  6  2 that budget year up to an amount equal to the
  6  3 difference.  The board of directors of a school
  6  4 district that wishes to receive a budget adjustment
  6  5 pursuant to this subsection shall, notwithstanding the
  6  6 public notice and hearing provisions of chapter 24 or
  6  7 any other provision to the contrary, within thirty
  6  8 days following April 6, 2000 the effective date of
  6  9 this Act, adopt a resolution to receive the budget
  6 10 adjustment and immediately notify the department of
  6 11 management of the adoption of the resolution and the
  6 12 amount of the budget adjustment to be received.
  6 13    Sec. 10.  Section 257.14, subsection 2, Code 2001,
  6 14 is amended by striking the subsection and inserting in
  6 15 lieu thereof the following:
  6 16    2.  For the budget year commencing July 1, 2002,
  6 17 and succeeding budget years, if the department of
  6 18 management determines that the regular program
  6 19 district cost of a school district for a budget year
  6 20 is less than one hundred one percent of the regular
  6 21 program district cost for the base year for that
  6 22 school district, a district shall be eligible for a
  6 23 budget adjustment corresponding to the following
  6 24 schedule:
  6 25    a.  For the budget year commencing July 1, 2002,
  6 26 the greater of the difference between the regular
  6 27 program district cost for the budget year and one
  6 28 hundred one percent of the regular program district
  6 29 cost for the base year, or ninety percent of the
  6 30 amount by which the budget guarantee as calculated for
  6 31 the budget year beginning July 1, 2001, exceeds the
  6 32 adjusted guarantee amount.  For purposes of this
  6 33 paragraph, the "adjusted guarantee amount" means the
  6 34 amount which would be applicable for the budget year
  6 35 beginning July 1, 2002, if the budget guarantee were
  6 36 determined for that budget year as calculated for the
  6 37 budget year beginning July 1, 2001.
  6 38    b.  For the budget year commencing July 1, 2003,
  6 39 the greater of the difference between the regular
  6 40 program district cost for the budget year and one
  6 41 hundred one percent of the regular program district
  6 42 cost for the base year, or eighty percent of the
  6 43 amount by which the budget guarantee as calculated for
  6 44 the budget year beginning July 1, 2001, exceeds the
  6 45 adjusted guarantee amount.  For purposes of this
  6 46 paragraph, the "adjusted guarantee amount" means the
  6 47 amount which would be applicable for the budget year
  6 48 beginning July 1, 2003, if the budget guarantee were
  6 49 determined for that budget year as calculated for the
  6 50 budget year beginning July 1, 2001.
  7  1    c.  For the budget year commencing July 1, 2004,
  7  2 the greater of the difference between the regular
  7  3 program district cost for the budget year and one
  7  4 hundred one percent of the regular program district
  7  5 cost for the base year, or seventy percent of the
  7  6 amount by which the budget guarantee as calculated for
  7  7 the budget year beginning July 1, 2001, exceeds the
  7  8 adjusted guarantee amount.  For purposes of this
  7  9 paragraph, the "adjusted guarantee amount" means the
  7 10 amount which would be applicable for the budget year
  7 11 beginning July 1, 2004, if the budget guarantee were
  7 12 determined for that budget year as calculated for the
  7 13 budget year beginning July 1, 2001.
  7 14    d.  For the budget year commencing July 1, 2005,
  7 15 the greater of the difference between the regular
  7 16 program district cost for the budget year and one
  7 17 hundred one percent of the regular program district
  7 18 cost for the base year, or sixty percent of the amount
  7 19 by which the budget guarantee as calculated for the
  7 20 budget year beginning July 1, 2001, exceeds the
  7 21 adjusted guarantee amount.  For purposes of this
  7 22 paragraph, the "adjusted guarantee amount" means the
  7 23 amount which would be applicable for the budget year
  7 24 beginning July 1, 2005, if the budget guarantee were
  7 25 determined for that budget year as calculated for the
  7 26 budget year beginning July 1, 2001.
  7 27    e.  For the budget year commencing July 1, 2006,
  7 28 the greater of the difference between the regular
  7 29 program district cost for the budget year and one
  7 30 hundred one percent of the regular program district
  7 31 cost for the base year, or fifty percent of the amount
  7 32 by which the budget guarantee as calculated for the
  7 33 budget year beginning July 1, 2001, exceeds the
  7 34 adjusted guarantee amount.  For purposes of this
  7 35 paragraph, the "adjusted guarantee amount" means the
  7 36 amount which would be applicable for the budget year
  7 37 beginning July 1, 2006, if the budget guarantee were
  7 38 determined for that budget year as calculated for the
  7 39 budget year beginning July 1, 2001.
  7 40    f.  For the budget year commencing July 1, 2007,
  7 41 the greater of the difference between the regular
  7 42 program district cost for the budget year and one
  7 43 hundred one percent of the regular program district
  7 44 cost for the base year, or forty percent of the amount
  7 45 by which the budget guarantee as calculated for the
  7 46 budget year beginning July 1, 2001, exceeds the
  7 47 adjusted guarantee amount.  For purposes of this
  7 48 paragraph, the "adjusted guarantee amount" means the
  7 49 amount which would be applicable for the budget year
  7 50 beginning July 1, 2007, if the budget guarantee were
  8  1 determined for that budget year as calculated for the
  8  2 budget year beginning July 1, 2001.
  8  3    g.  For the budget year commencing July 1, 2008,
  8  4 the greater of the difference between the regular
  8  5 program district cost for the budget year and one
  8  6 hundred one percent of the regular program district
  8  7 cost for the base year, or thirty percent of the
  8  8 amount by which the budget guarantee as calculated for
  8  9 the budget year beginning July 1, 2001, exceeds the
  8 10 adjusted guarantee amount.  For purposes of this
  8 11 paragraph, the "adjusted guarantee amount" means the
  8 12 amount which would be applicable for the budget year
  8 13 beginning July 1, 2008, if the budget guarantee were
  8 14 determined for that budget year as calculated for the
  8 15 budget year beginning July 1, 2001.
  8 16    h.  For the budget year commencing July 1, 2009,
  8 17 the greater of the difference between the regular
  8 18 program district cost for the budget year and one
  8 19 hundred one percent of the regular program district
  8 20 cost for the base year, or twenty percent of the
  8 21 amount by which the budget guarantee as calculated for
  8 22 the budget year beginning July 1, 2001, exceeds the
  8 23 adjusted guarantee amount.  For purposes of this
  8 24 paragraph, the "adjusted guarantee amount" means the
  8 25 amount which would be applicable for the budget year
  8 26 beginning July 1, 2009, if the budget guarantee were
  8 27 determined for that budget year as calculated for the
  8 28 budget year beginning July 1, 2001.
  8 29    i.  For the budget year commencing July 1, 2010,
  8 30 the greater of the difference between the regular
  8 31 program district cost for the budget year and one
  8 32 hundred one percent of the regular program district
  8 33 cost for the base year, or ten percent of the amount
  8 34 by which the budget guarantee as calculated for the
  8 35 budget year beginning July 1, 2001, exceeds the
  8 36 adjusted guarantee amount.  For purposes of this
  8 37 paragraph, the "adjusted guarantee amount" means the
  8 38 amount which would be applicable for the budget year
  8 39 beginning July 1, 2010, if the budget guarantee were
  8 40 determined for that budget year as calculated for the
  8 41 budget year beginning July 1, 2001.
  8 42    j.  For the budget year commencing July 1, 2011,
  8 43 and each budget year thereafter, the difference
  8 44 between the regular program district cost for the
  8 45 budget year and one hundred one percent of the regular
  8 46 program district cost for the base year.
  8 47    For the purposes of this subsection, a school
  8 48 district shall be eligible to apply the eighty,
  8 49 seventy, sixty, fifty, forty, thirty, twenty, and ten
  8 50 percent provisions in paragraphs "b" through "i", only
  9  1 if the school district received a budget adjustment
  9  2 for the budget year beginning July 1, 2002, based on
  9  3 the ninety percent provision in paragraph "a".
  9  4    The board of directors of a school district that
  9  5 wishes to receive a budget adjustment pursuant to this
  9  6 subsection shall adopt a resolution to receive the
  9  7 budget adjustment and shall, by April 1, annually,
  9  8 notify the department of management of the adoption of
  9  9 the resolution and the amount of the budget adjustment
  9 10 to be received.
  9 11    Sec. 11.  EFFECTIVE DATE.  Sections 4 and 9 of this
  9 12 Act, being deemed of immediate importance, take effect
  9 13 upon enactment."

  9 15 inserting the following:  "An Act relating to certain
  9 16 school finance provisions and providing an effective
  9 17 date."
