  1  1    Amend Senate File 342 as follows:
  1  2    #1.  Page 1, by inserting after line 7, the
  1  3 following:
  1  4    "Sec.    .  Section 53.2, unnumbered paragraph 1,
  1  5 Code 2001, is amended to read as follows:
  1  6    Any registered voter, under the circumstances
  1  7 specified in section 53.1, may on any day, except
  1  8 election day, and not more than seventy days prior to
  1  9 the date of the election, apply in person for an
  1 10 absentee ballot at the commissioner's office or at any
  1 11 location designated by the commissioner, or make
  1 12 written or facsimile application to the commissioner
  1 13 for an absentee ballot.  The state commissioner shall
  1 14 prescribe a form for absentee ballot applications.
  1 15 However, if a registered voter submits an application
  1 16 that includes all of the information required in this
  1 17 section, the prescribed form is not required.
  1 18 Absentee ballot applications may include instructions
  1 19 to send the application directly to the county
  1 20 commissioner of elections.  However, no absentee
  1 21 ballot application shall be preaddressed or printed
  1 22 with instructions to send the applications to anyone
  1 23 other than the appropriate commissioner.
  1 24    Sec.    .  Section 53.21, unnumbered paragraph 1,
  1 25 Code 2001, is amended to read as follows:
  1 26    A voter who has requested an absentee ballot may
  1 27 obtain a replacement ballot if the voter declares that
  1 28 the original ballot was lost or did not arrive.  The
  1 29 commissioner upon receipt of a written or written,
  1 30 oral, or facsimile request for a replacement ballot
  1 31 shall provide a duplicate ballot.  The same serial
  1 32 number that was assigned to the records of the
  1 33 original absentee ballot request shall be used on the
  1 34 envelopes and records of the replacement ballot.
  1 35    Sec.    .  Section 53.22, subsection 2, Code 2001,
  1 36 is amended to read as follows:
  1 37    2.  Any registered voter who becomes a patient or
  1 38 resident of a hospital or health care facility in the
  1 39 county where the voter is registered to vote within
  1 40 three days prior to the date of any election or on
  1 41 election day may request an absentee ballot during
  1 42 that period or on election day.  As an alternative to
  1 43 the application procedure prescribed by section 53.2,
  1 44 the registered voter may make the request directly to
  1 45 the officers who are delivering and returning absentee
  1 46 ballots under this section.  Alternatively, the
  1 47 request may be made by telephone or fascimile to the
  1 48 office of the commissioner not later than four hours
  1 49 before the close of the polls.  If the requester is
  1 50 found to be a registered voter of that county, these
  2  1 officers shall deliver the appropriate absentee ballot
  2  2 to the registered voter in the manner prescribed by
  2  3 this section.
  2  4    Sec.    .  Section 53.22, subsection 5, unnumbered
  2  5 paragraph 1, Code 2001, is amended to read as follows:
  2  6    If the registered voter becomes a patient or
  2  7 resident of a hospital or health care facility outside
  2  8 the county where the voter is registered to vote
  2  9 within three days before the date of any election or
  2 10 on election day, the voter may designate a person to
  2 11 deliver and return the absentee ballot.  The designee
  2 12 may be any person the voter chooses except that no
  2 13 candidate for any office to be voted upon for the
  2 14 election for which the ballot is requested may deliver
  2 15 a ballot under this subsection.  The request for an
  2 16 absentee ballot may be made by telephone or facsimile
  2 17 to the office of the commissioner not later than four
  2 18 hours before the close of the polls.  If the requester
  2 19 is found to be a registered voter of that county, the
  2 20 ballot shall be delivered by mail or by the person
  2 21 designated by the voter.  An application form shall be
  2 22 included with the absentee ballot and shall be signed
  2 23 by the voter and returned with the ballot."

  2 25 word "Act" the following:  "relating to the conduct of
  2 26 elections by authorizing absentee ballot requests by
  2 27 facsimile and by".
