1 2 #1. Page 1, by inserting after line 7, the
1 3 following:
1 4 "Sec. . NEW SECTION. 53.19A LISTS OF ABSENTEE
1 5 VOTERS.
1 6 1. Any person may request of the commissioner and
1 7 shall receive, upon payment of the cost of
1 8 preparation, a list of absentee voters in accordance
1 9 with the following requirements and limitations:
1 10 a. The commissioner shall prepare each list
1 11 requested within three days of receipt of the request,
1 12 except that the commissioner shall not be required to
1 13 prepare any list within five days of the election for
1 14 which the list is requested.
1 15 b. Each list shall be as current as possible, but
1 16 shall in all cases reflect absentee voter activity
1 17 recorded by the commissioner seven or more days before
1 18 preparation of the list.
1 19 c. Each list shall be in the order and form
1 20 specified by the list purchaser, and shall contain the
1 21 absentee voter data specified by the list purchaser,
1 22 provided that compliance with the request is within
1 23 the capability of the record maintenance system used
1 24 by the commissioner.
1 25 d. Absentee voter information shall be maintained
1 26 in an electronic medium. The commissioner shall
1 27 prepare updates to lists at least weekly. All updates
1 28 shall be made available to all requesters at the same
1 29 time, and shall be in the order and form specified by
1 30 each requester.
1 31 2. The commissioner shall maintain a log of the
1 32 name, address, and telephone number of every person
1 33 who receives a list under this section, and of every
1 34 person who reviews absentee voter records in the
1 35 office of the commissioner. Logs maintained under
1 36 this subsection are public records, and shall be
1 37 available for public inspection at reasonable times.
1 38 3. Information about absentee voters obtained from
1 39 absentee voter records shall be used only for a
1 40 genuine political purpose, or for a bona fide official
1 41 purpose by an elected official, or for bona fide
1 42 political research, but shall not be used for any
1 43 commercial purposes. A person who uses absentee voter
1 44 information in violation of this section commits a
1 45 serious misdemeanor.
1 46 4. Lists of absentee voters shall be preserved and
1 47 destroyed in the same manner as are ballots for
1 48 elections under section 50.19."
1 49 #2. Title page, line 1 by inserting after the word
1 50 "Act" the following: "relating to the conduct of
2 1 elections by providing for the availability of
2 2 absentee voter lists and by".
