  1  1    Amend Senate File 84 as follows:
  1  2    #1.  Page 1, lines 7 and 8, by striking the words
  1  3 "purple loosestrife (lythrum virgatum),".
  1  4    #2.  Page 1, line 9, by inserting after the word
  1  5 "state." the following:  "A person shall not sell or
  1  6 offer for sale purple loosestrife (lythrum virgatum)
  1  7 or seeds of the plant in any form in this state."
  1  8    #3.  Page 1, by striking lines line 12 through 23
  1  9 and inserting the following:  "roses or ornamental
  1 10 shrubs in gardens.  This section also does not
  1 11 prohibit the sale, or offer for sale, or distribution
  1 12 of varieties of the purple loosestrife (lythrum
  1 13 virgatum) when used for ornamental gardens, and which
  1 14 are sterile or nonaggressive according to a list
  1 15 published by the state weed commissioner pursuant to
  1 16 chapter 17A sold or offered for sale to retailers
  1 17 outside of this state if the seller was engaged in
  1 18 that wholesale business as of January 1, 2001.  A
  1 19 person engaged in the business of selling purple
  1 20 loosestrife to out-of-state retailers shall keep
  1 21 accurate records, as specified by the department of
  1 22 agriculture and land stewardship, of each variety of
  1 23 purple loosestrife sold, or offered for sale, or
  1 24 distributed.  The person shall allow the department of
  1 25 agriculture and land stewardship to inspect the
  1 26 records during regular business hours.  Any person
  1 27 violating".
  1 28    #4.  Title page, by striking lines 1 and 2 and
  1 29 inserting the following:  "An Act prohibiting the sale
  1 30 or offer for sale of purple loosestrife except to out-
  1 31 of-state retailers and subjecting violators to an
  1 32 existing penalty."
