  1  1    Amend Senate File 259 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 910.7A, Code 2001, is amended
  1  5 by adding the following new subsection:
  1  6    NEW SUBSECTION.  3.  The court shall not discharge
  1  7 a defendant's obligation to pay pecuniary damages to a
  1  8 victim under an order for restitution, unless one of
  1  9 the following occurs:
  1 10    (a)  The victim or the victim's estate has
  1 11 consented in writing to the discharge.
  1 12    (b)  The court determines, after a hearing, that
  1 13 the defendant's obligation should be discharged.
  1 14 Notice of the hearing shall be given to the victim or
  1 15 the victim's estate, the defendant, and the county
  1 16 attorney.  The victim shall be given an opportunity to
  1 17 be heard at the hearing."
  1 18    #2.  Title page, line 1, by striking the words "the
  1 19 victim rights" and inserting the following:  "crime
  1 20 victim".
  1 21    #3.  Title page, line 1, by striking the word
  1 22 "fund".
  1 23    #4.  By renumbering as necessary.
