  1  1    Amend Senate File 342 to read as follows:
  1  2    #1.  Page 1, by inserting before line 1, the
  1  3 following:
  1  4    "Section 1.  Section 48A.6, subsection 1, Code
  1  5 2001, is amended to read as follows:
  1  6    1.  A person who has been convicted of a felony as
  1  7 defined in section 701.7, or convicted of an offense
  1  8 classified as a felony under federal law.  If When the
  1  9 person's rights are later restored by the governor, or
  1 10 by the president of the United States, pursuant to
  1 11 section 914.8, the person may register to vote."
  1 12    #2.  Page 1, by inserting after line 7, the
  1 13 following:
  1 14    "Sec.    .  Section 914.2, Code 2001, is amended to
  1 15 read as follows:
  1 16    914.2  RIGHT OF APPLICATION.
  1 17    Except as otherwise provided in section 902.2 or
  1 18 914.8, a person convicted of a criminal offense has
  1 19 the right to make application to the board of parole
  1 20 for recommendation or to the governor for a reprieve,
  1 21 pardon, commutation of sentence, remission of fines or
  1 22 forfeitures, or restoration of rights of citizenship
  1 23 at any time following the conviction.
  1 24    Sec.    .  Section 914.6, subsection 3, Code 2001,
  1 25 is amended to read as follows:
  1 26    3.  In the case of a remission of fines and
  1 27 forfeitures, restoration of rights of citizenship
  1 28 other than the right to register to vote and to vote,
  1 29 or a pardon, commutation of sentence, or reprieve, if
  1 30 the person is not in custody, one copy of the
  1 31 executive instrument shall be delivered to the person
  1 32 and one copy to the clerk of the district court where
  1 33 the judgment is of record.  A list of the restorations
  1 34 of rights of citizenship issued by the governor shall
  1 35 be delivered to the state registrar of voters at least
  1 36 once each month.
  1 37    Sec.    .  NEW SECTION.  914.8  RESTORATION OF
  1 38 RIGHT TO REGISTER AND TO VOTE.
  1 39    1.  A person convicted of a felony criminal offense
  1 40 who has been discharged from probation under section
  1 41 907.9, discharged from parole or work release under
  1 42 section 906.15, or who is released from confinement
  1 43 under section 902.6 because the person has completed
  1 44 the person's term of confinement shall have the right
  1 45 to register to vote and to vote restored in the manner
  1 46 provided in this section.
  1 47    2.  Upon discharge from confinement or supervision,
  1 48 the department of corrections or judicial district
  1 49 department of correctional services, whichever is
  1 50 applicable, shall provide written notice to the
  2  1 inmate, parolee, or probationer of the person's
  2  2 discharge which shall include a statement that the
  2  3 person's right to register to vote and to vote has
  2  4 been restored.
  2  5    3.  The department of corrections shall monthly
  2  6 provide a list of all persons discharged from
  2  7 confinement or supervision to the state registrar of
  2  8 voters who shall provide the information to the county
  2  9 registrars of voters as deemed necessary."
  2 10    #3.  Title page, line 2, by inserting after the
  2 11 word "voting" the following:  "and restoring for
  2 12 certain persons the right to register to vote and to
  2 13 vote".
  2 14    #4.  By renumbering as necessary.
