1 2 #1. Page 1, line 3, by inserting after the word
1 3 "PROPERTY." the following: "a."
1 4 #2. Page 1, by inserting after line 15 the
1 5 following:
1 6 "b. This subsection shall not apply to the
1 7 following:
1 8 (1) The intentional or reckless disregard of
1 9 design plans, specifications, or building codes,
1 10 including but not limited to the substitution of
1 11 specified materials without the knowledge of the
1 12 purchaser.
1 13 (2) Fraud or misrepresentation.
1 14 (3) Breach of express warranty or guarantee.
1 15 (4) Defective products.
1 16 (5) Waiver of the provisions of this subsection by
1 17 contract of the parties.
1 18 (6) Prolonged exposure to hazardous waste; removal
1 19 or encapsulation of asbestos; or application of
1 20 environmental remediation.
1 21 (7) Actions brought by the state or any
1 22 governmental subdivision, including but not limited to
1 23 any county, city, school district, or municipality.
1 24 (8) Willful misconduct, gross negligence, or
1 25 fraudulent concealment of defects.
1 26 (9) Improvements to real property made prior to
1 27 the effective date of this Act."
