  1  1    Section 1.  NEW SECTION.  13.11  IDENTITY THEFT ADVOCATE.
  1  2    1.  The position of identity theft advocate is established
  1  3 within the consumer protection division of the department of
  1  4 justice.  The identity theft advocate shall perform the
  1  5 advocate's duties under the direction of the attorney general.
  1  6    2.  The identity theft advocate shall assist in the
  1  7 prevention, identification, and prosecution of identity theft
  1  8 by performing the following:
  1  9    a.  Training law enforcement officers and prosecutors.
  1 10    b.  Educating the public regarding identity theft
  1 11 occurrence and prevention.
  1 12    c.  Compiling information about criminal prosecutions and
  1 13 civil actions in Iowa courts concerning identity theft.
  1 14    d.  Assisting victims of identity theft.
  1 15    e.  Assisting with the prosecution of identity theft.
  1 16    f.  Consulting with state agencies, including but not
  1 17 limited to the department of public safety and the information
  1 18 technology department, regarding the detection and prevention
  1 19 of identity theft involving state agency information
  1 20 technology systems.
  1 21    g.  Performing such other duties as may be assigned by the
  1 22 attorney general.
  1 23    3.  The staffing of this position shall be contingent upon
  1 24 an appropriation from the general fund of the state to the
  1 25 department of justice of a sufficient amount of funding to
  1 26 attract and retain an identity theft advocate.  
  1 27                           EXPLANATION
  1 28    This bill provides for the creation of the position of
  1 29 identity theft advocate within the consumer protection
  1 30 division of the department of justice.  The bill provides that
  1 31 the identity theft advocate shall perform the advocate's
  1 32 duties under the direction of the attorney general.
  1 33    The bill provides that the identity theft advocate shall
  1 34 assist in the prevention, identification, and prosecution of
  1 35 identity theft, and specifies several specific
  2  1 responsibilities relating thereto.  The bill provides that the
  2  2 identity theft advocate shall train law enforcement officers
  2  3 and prosecutors, educate the public regarding identity theft
  2  4 occurrence and prevention, compile information about criminal
  2  5 prosecutions and civil actions concerning identity theft,
  2  6 assist identity theft victims and prosecution efforts, consult
  2  7 with state agencies, including but not limited to the
  2  8 department of public safety and the information technology
  2  9 department, regarding the detection and prevention of identity
  2 10 theft involving state agency information technology systems,
  2 11 and perform other duties as assigned by the attorney general.
  2 12 The bill additionally provides that staffing the position of
  2 13 identity theft advocate shall be contingent upon receipt of a
  2 14 sufficient appropriation from the general fund of the state to
  2 15 the department of justice.
