  1  1    Section 1.  Section 702.11, subsection 2, paragraph b, Code
  1  2 Supplement 2001, is amended by striking the paragraph.  
  1  3                           EXPLANATION
  1  4    This bill makes sexual abuse in the third degree committed
  1  5 between spouses a forcible felony.  A person convicted of a
  1  6 forcible felony is not eligible to receive a deferred judgment
  1  7 or a deferred or suspended sentence under Code section 907.3.
  1  8 Sexual abuse in the third degree is a class "C" felony.
  1  9    A class "C" felony is punishable by confinement for no more
  1 10 than 10 years and a fine of at least $1,000 but not more than
  1 11 $10,000.
