1 1 Section 1. NEW SECTION. 147.57A DEFAULT OR BREACH OF
1 2 CONTRACT – STUDENT LOANS AND SCHOLARSHIPS.
1 3 1. A license to practice a profession may be revoked or
1 4 suspended if the examining board for the profession in which
1 5 the person is licensed receives information from the
1 6 administering entity that the person has defaulted on a
1 7 student loan, has breached a student loan repayment contract,
1 8 or has failed to perform the person's service obligation under
1 9 a scholarship contract. A license revoked or suspended under
1 10 this section shall not be reinstated or reissued until the
1 11 person provides the examining board with a written release
1 12 issued by the administering entity stating that the person is
1 13 making payments on the loan or is satisfying the service
1 14 requirements in accordance with an agreement approved by the
1 15 administering entity.
1 16 2. For the purpose of this section, "administering entity"
1 17 means any entity that administers a state or federal program
1 18 that provides student loans, loan repayment contracts, or
1 19 scholarship contracts for the education of persons seeking to
1 20 practice a profession regulated under this chapter, including,
1 21 but not limited to, the health resources and services
1 22 administration of the United States department of health and
1 23 human services.
1 24 EXPLANATION
1 25 This bill provides that the license of a person to practice
1 26 a health-related profession may be revoked or suspended if the
1 27 examining board for the profession in which the person is
1 28 licensed receives information from the administering entity
1 29 that the person has defaulted on a student loan, has breached
1 30 a student loan repayment contract, or has failed to perform
1 31 the person's service obligation under a scholarship contract.
1 32 A license revoked or suspended under the bill cannot be
1 33 reinstated or reissued until the person provides the examining
1 34 board with a written release issued by the administering
1 35 entity stating that the person is making payments on the loan
2 1 or is satisfying the service requirements in accordance with
2 2 an agreement approved by the administering entity. For the
2 3 purposes of the bill, "administering entity" means any entity
2 4 that administers a state or federal program that provides
2 5 student loans, loan repayment contracts, or scholarship
2 6 contracts for the education of persons seeking to practice a
2 7 health-related profession, including, but not limited to, the
2 8 health resources and services administration of the United
2 9 States department of health and human services.
