  1  1    Section 1.  Section 148A.2, Code 2001, is amended by adding
  1  2 the following new unnumbered paragraph:
  1  3    NEW UNNUMBERED PARAGRAPH.  A person or business entity,
  1  4 including the employees, agents, or representatives of the
  1  5 business entity, shall not use in connection with that
  1  6 person's name or the name or activity of the business entity,
  1  7 the words "physical therapy", "physical therapist",
  1  8 "physiotherapy", "licensed physical therapist",
  1  9 "physiotherapist", "registered physical therapist", "doctor of
  1 10 physical therapy", "physical therapist assistant",
  1 11 "physiotherapist assistant", "licensed physical therapist
  1 12 assistant", "registered physical therapist assistant", or the
  1 13 letters "P.T.", "L.P.T.", "R.P.T.", "D.P.T.", "P.T.A.",
  1 14 "L.P.T.A.", "R.P.T.A.", or any other words, abbreviations, or
  1 15 insignia indicating or implying directly or indirectly that
  1 16 physical therapy or physiotherapy is provided or supplied,
  1 17 unless such services are provided by or under the direction
  1 18 and supervision of a physical therapist licensed pursuant to
  1 19 this chapter.  A person or entity that violates this paragraph
  1 20 is guilty of a serious misdemeanor, and a license to practice
  1 21 shall be revoked or suspended pursuant to section 147.55.
  1 22    Sec. 2.  Section 148A.3, subsection 1, Code 2001, is
  1 23 amended by striking the subsection and inserting in lieu
  1 24 thereof the following:
  1 25    1.  A person licensed under any other chapter of the Code
  1 26 who is engaged in the practice of the person's profession if
  1 27 that person does not represent, imply, or claim that the
  1 28 person is a physical therapist, physiotherapist, doctor of
  1 29 physical therapy, physical therapist assistant,
  1 30 physiotherapist assistant, or a provider of physical therapy
  1 31 or physiotherapy.
  1 32    Sec. 3.  Section 148A.3, subsection 5, Code 2001, is
  1 33 amended by striking the subsection.  
  1 34                           EXPLANATION
  1 35    This bill provides title restrictions relating to the
  2  1 practice of physical therapy.  The bill provides that a person
  2  2 or business entity, including the employees, agents, or
  2  3 representatives of the business entity, shall not use in
  2  4 connection with their name or business activity a specified
  2  5 list of titles and abbreviations indicating that physical
  2  6 therapy or physiotherapy is provided or supplied, unless such
  2  7 services are provided by or under the direction and
  2  8 supervision of a physical therapist licensed pursuant to Code
  2  9 chapter 148A.  The bill provides that a person or entity that
  2 10 violates this provision is guilty of a serious misdemeanor,
  2 11 and that a license to practice shall be revoked or suspended
  2 12 pursuant to Code section 147.55.
  2 13    The bill also provides that persons licensed under any
  2 14 other Code chapter who are engaged in the practice of their
  2 15 professions are not restricted by the provisions of Code
  2 16 chapter 148A if such a person does not represent, imply, or
  2 17 claim that the person is a physical therapist,
  2 18 physiotherapist, doctor of physical therapy, physical
  2 19 therapist assistant, physiotherapist assistant, or a provider
  2 20 of physical therapy or physiotherapy.  The bill deletes a Code
  2 21 provision which currently and specifically exempts massage
  2 22 therapists, massage technicians, masseurs and masseuses who
  2 23 administer body massage by Swedish or other massage technique,
  2 24 including modalities, in a massage establishment, health club,
  2 25 athletic club, or school athletic department, from the
  2 26 requirements of Code chapter 148A, provided such individuals
  2 27 do not designate themselves to be physical therapists.
