PAG LIN 1 1 Section 1. Section 257.35, Code 2001, is amended to read 1 2 as follows: 1 3 257.35 AREA EDUCATION AGENCY PAYMENTS. 1 4 1. The department of management shall deduct the amounts 1 5 calculated for special education support services, media 1 6 services, and educational services for each school district 1 7 from the state aid due to the district pursuant to this 1 8 chapter and shall pay the amounts to the respective area 1 9 education agencies on a monthly basis from September 15 1 10 through June 15 during each school year. The department of 1 11 management shall notify each school district of the amount of 1 12 state aid deducted for these purposes and the balance of state 1 13 aid shall be paid to the district. If a district does not 1 14 qualify for state aid under this chapter in an amount 1 15 sufficient to cover its amount due to the area education 1 16 agency as calculated by the department of management, the 1 17 school district shall pay the deficiency to the area education 1 18 agency from other moneys received by the district, on a 1 19 quarterly basis during each school year. 1 20 2. Notwithstanding subsection 1, the state aid for area 1 21 education agencies and the portion of the combined district 1 22 cost calculated for these agencies for each fiscal year of the 1 23 fiscal period beginning July 1, 2002, and ending June 30, 1 24 2004, shall be reduced by the department of management by 1 25 seven million five hundred thousand dollars. The reduction 1 26 for each area education agency shall be equal to the reduction 1 27 that the agency received in the fiscal year beginning July 1, 1 28 2001. 1 29 Sec. 2. Section 257.37, Code 2001, is amended by adding 1 30 the following new subsection: 1 31 NEW SUBSECTION. 6. For the budget years beginning July 1, 1 32 2002, and July 1, 2003, notwithstanding the requirements of 1 33 this section for determining the budgets and funding of media 1 34 services and education services, an area education agency may, 1 35 within the limits of the total of the funds provided for the 2 1 budget years pursuant to section 257.35, expend for special 2 2 education support services an amount that exceeds the payment 2 3 for special education support services pursuant to section 2 4 257.35 in order to maintain the level of required special 2 5 education support services in the area education agency. 2 6 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 7 immediate importance, takes effect upon enactment. 2 8 EXPLANATION 2 9 This bill provides that the state school foundation aid for 2 10 area education agencies and the portion of the combined 2 11 district cost calculated for these agencies for the fiscal 2 12 years beginning July 1, 2002, and July 1, 2003, shall be 2 13 reduced for each fiscal year by the department of management 2 14 by $7,500,000. The bill also provides that the amount of the 2 15 reduction for each area education agency shall equal the 2 16 reduction that each agency received in the fiscal year 2 17 beginning July 1, 2001. The bill additionally provides that 2 18 for the fiscal years beginning July 1, 2002, and July 1, 2003, 2 19 an area education agency may, within the limits of the total 2 20 of the funds provided to an area education agency pursuant to 2 21 Code section 257.35, expend for special education support 2 22 services an amount that exceeds the payment for special 2 23 education support services pursuant to Code section 257.35 in 2 24 order to maintain the level of required special education 2 25 support services in the area education agency. 2 26 The bill takes effect upon enactment. 2 27 LSB 5946XL 79 2 28 rn/cf/24
