1 1 Section 1. Section 624.23, Code 2001, is amended by adding
1 2 the following new subsections:
1 3 NEW SUBSECTION. 5. A judgment lien attaching to the real
1 4 estate of a city may be discharged at any time by the city
1 5 filing with the clerk of the district court in which the
1 6 judgment was entered a bond in the amount for which the
1 7 judgment was entered, including court costs and accruing
1 8 interest, with surety or sureties to be approved by the clerk,
1 9 conditioned for the payment of the judgment amount, interest,
1 10 and court costs. If the real estate is located in a county
1 11 other than that in which the judgment was entered, the clerk
1 12 of the district court in which the judgment was entered shall
1 13 certify to the clerk of the district court of the county in
1 14 which the real estate is located that the bond has been filed.
1 15 NEW SUBSECTION. 6. A judgment against a city shall not
1 16 give rise to a lien attaching to the streets, alleys, or
1 17 utility easements of a city or attaching to the real estate of
1 18 a city which is used by the city for transportation, health,
1 19 safety, or utility purposes.
1 20 EXPLANATION
1 21 This bill allows a city to discharge a judgment lien
1 22 against the real estate of the city if the city files a bond
1 23 in the amount of the judgment with the clerk of the district
1 24 court in which the judgment was entered.
1 25 The bill also prohibits a judgment lien from attaching to
1 26 the streets, alleys, or utility easements of a city or to the
1 27 real estate of a city which is used by the city for
1 28 transportation, health, safety, or utility purposes.
