PAG LIN 1 1 Section 1. Section 96.11, Code Supplement 2001, is amended 1 2 by adding the following new subsection: 1 3 NEW SUBSECTION. 11A. UNEMPLOYMENT BENEFITS CONTESTED CASE 1 4 HEARING RECORDS. Notwithstanding the provisions of section 1 5 17A.12 to the contrary, the recording or stenographic notes of 1 6 oral proceedings of a hearing conducted before an 1 7 administrative law judge pursuant to section 96.6, subsection 1 8 3, or the transcription thereof, shall be filed with and 1 9 maintained by the department for at least one year from the 1 10 date of decision. 1 11 EXPLANATION 1 12 This bill requires that the department of workforce 1 13 development retain unemployment insurance contested case 1 14 hearing tape recordings and transcripts for one year from the 1 15 date of decision of the administrative law judge rather than 1 16 five years from the date of decision as required by Code 1 17 chapter 17A. 1 18 LSB 5349DP 79 1 19 ec/pj/5
