PAG LIN 1 1 Section 1. Section 822.5, Code 2001, is amended to read as 1 2 follows: 1 3 822.5 PAYMENT OF COSTS. 1 4 1. If the applicant is unable to pay court costs and 1 5 stenographic and printing expenses, these costs and expenses 1 6 shall be made available to the applicant in the trial court, 1 7 and on review. 1 8 2. Unless the applicant is confined in a state institution 1 9 and is seeking relief under section 822.2, subsections 5 and 1 10 6, the costs and expenses of legal representation shall also 1 11 be made available to the applicant in the preparation of the 1 12 application, in the trial court, and on review if the 1 13 applicant is unable to pay. 1 14 3. The costs and expenses, including legal expenses made 1 15 available pursuant to subsections 1 and 2, shall be reimbursed 1 16 to the state as provided in chapter 815. 1 17 4.However, nothing in thisThis section shall not be 1 18 interpreted to require payment of expenses of legal 1 19 representation, including stenographic, printing, or other 1 20 legal services or consultation, when the applicant is self- 1 21 represented or is utilizing the services of an inmate. 1 22 EXPLANATION 1 23 This bill relates to the reimbursement of costs and 1 24 expenses incurred by an indigent person for filing an 1 25 application for postconviction relief. 1 26 The bill provides that an indigent person who files an 1 27 application for certain claims for postconviction relief shall 1 28 reimburse the state the costs and expenses including legal 1 29 expenses in the same manner as other court-appointed cases. 1 30 Current law provides that costs and expenses incurred by an 1 31 indigent person filing an application for certain 1 32 postconviction relief claims be made available to the person. 1 33 LSB 5243DP 79 1 34 jm/cls/14
