  1  1    Section 1.  Section 802.6, subsection 1, Code 2001, is
  1  2 amended to read as follows:
  1  3    1.  When a person leaves the state with the intention of
  1  4 avoiding prosecution is not present in the state, the
  1  5 indictment or prosecution information may be found or
  1  6 commenced within the time herein limited after the person's
  1  7 coming into the state, and no period during which the party
  1  8 charged was not publicly resident present within the state is
  1  9 a part of the limitation.  
  1 10                           EXPLANATION
  1 11    This bill relates to the filing of a criminal indictment or
  1 12 trial information.
  1 13    The bill provides that the period of time to file an
  1 14 indictment or trial information to charge a person with a
  1 15 criminal offense does not run unless the person is present in
  1 16 the state.
  1 17    Current law provides that the time to file an indictment or
  1 18 trial information only tolls if the person leaves the state
  1 19 with the intent to avoid prosecution.
  1 20    The Iowa rules of criminal procedure specify that an
  1 21 indictment or trial information must be filed within 45 days
  1 22 of arrest.
