PAG LIN 1 1 Section 1. Section 669.14, subsection 10, Code Supplement 1 2 2001, is amended to read as follows: 1 3 10. Any claim based upon an act or omission in the 1 4 application or enforcement ofchaptersections 30.7 and 85.68, 1 5 and chapters 88, 88A, 88B, 89, 89A, 89B, 90A, 91, 91A, 91C, 1 6 91D, 91E, 92, and 94A. 1 7 EXPLANATION 1 8 This bill adds an exception to the state tort claims Act 1 9 for several duties involving the division of labor services of 1 10 the department of workforce development. The bill provides 1 11 immunity for any act or omission in the application or 1 12 enforcement of Code sections concerning chemical emergencies 1 13 and second injury fund collections, and Code chapters 1 14 concerning occupational safety and health (88), amusement ride 1 15 inspections (88A), asbestos removal (88B), boilers and unfired 1 16 steam pressure vessels (89), elevators (89A), boxing and 1 17 wrestling (90A), the labor services division generally (91), 1 18 wage payment collection (91A), construction contractors (91C), 1 19 minimum wage (91D), non-English speaking employees (91E), 1 20 child labor (92), and employment agencies (94A). Under 1 21 current law, the tort claims exception applies to hazardous 1 22 chemicals risks under Code chapter 89B. 1 23 LSB 5351DP 79 1 24 ec/sh/8
