  1  1    Section 1.  Section 172E.1, subsection 1, Code Supplement
  1  2 2001, is amended by striking the subsection and inserting in
  1  3 lieu thereof the following:
  1  4    1.  "Bovine animal" means an animal classified as bovine,
  1  5 including domesticated breeds of cattle, bison, or a hybrid of
  1  6 cattle and bison, regardless of the age or sex of the animal.
  1  7    Sec. 2.  Section 172E.2, subsection 1, Code Supplement
  1  8 2001, is amended to read as follows:
  1  9    1.  If a livestock market accepts dairy cattle upon express
  1 10 written condition that the dairy cattle are to be moved
  1 11 directly bovine animal for sale to slaughter, the dairy cattle
  1 12 bovine animal shall be segregated with other livestock to be
  1 13 moved directly to slaughter until sold to a packer.  A person
  1 14 shall not knowingly sell the dairy cattle the bovine animal to
  1 15 a purchaser other than to a packer at the livestock market.  A
  1 16 person other than a packer shall not knowingly purchase the
  1 17 dairy cattle bovine animal at the livestock market.  
  1 18                           EXPLANATION
  1 19    During the General Assembly's regular session in 2001, it
  1 20 enacted Senate File 209 (2001 Acts, regular session, chapter
  1 21 101) that provided for the control of infectious or contagious
  1 22 diseases in cattle and other animals.  Part of that Act
  1 23 established new Code chapter 165A regulating paratuberculosis
  1 24 which primarily affects dairy cattle, and new Code chapter
  1 25 172E requiring that if a livestock market accepts dairy cattle
  1 26 upon express written condition that the dairy cattle are to be
  1 27 moved directly to slaughter, the dairy cattle must be
  1 28 segregated with other livestock to be moved directly to
  1 29 slaughter until sold to a packer.  Under both chapters, the
  1 30 penalty for a violation is a civil penalty of at least $100
  1 31 but not more than $1,000.
  1 32    This bill amends provisions in Code chapter 172E, including
  1 33 Code section 172E.2, by providing that if a livestock market
  1 34 accepts a bovine animal (i.e., domesticated breeds of cattle,
  1 35 bison, or hybrids) for sale to slaughter, the bovine animal
  2  1 shall be segregated with other livestock to be moved directly
  2  2 to slaughter until sold.
