  1  1    Section 1.  Section 480.3, subsection 1, paragraph a, Code
  1  2 2001, is amended to read as follows:
  1  3    a.  A statewide notification center is established and
  1  4 shall be organized as a nonprofit corporation pursuant to
  1  5 chapter 504A.
  1  6    (1)  The center shall be governed by a board of directors
  1  7 which shall represent and be elected by operators, excavators,
  1  8 and other persons who participate in the center.  The board,
  1  9 with input from all interested parties, shall determine the
  1 10 operating procedures and technology needed for a single
  1 11 statewide notification center and establish a notification
  1 12 process.
  1 13    (2)  In addition, the board shall either establish a
  1 14 competitive bidding procedure to select a vendor to provide
  1 15 the notification service or retain sufficient and necessary
  1 16 staff to provide the notification service.
  1 17    (a)  If a vendor is selected, the vendor contract shall be
  1 18 for a three-year period, which may be extended upon the
  1 19 approval of the board for a period not exceeding an additional
  1 20 three years.  The terms of the agreement for the notification
  1 21 service vendor contract may be modified from time to time by
  1 22 the board, and the agreement vendor.  The contract shall be
  1 23 reviewed, with an opportunity to receive new bids, no less
  1 24 frequently than every three years at the end of the term of
  1 25 the contract.
  1 26    (b)  If the board retains staff to provide the notification
  1 27 service, the board, at the board's discretion, may review the
  1 28 notification service at any time and make a determination to
  1 29 use the competitive bidding procedure to select a vendor.  
  1 30                           EXPLANATION
  1 31    This bill amends Code section 480.3, relating to the
  1 32 establishment of a single statewide underground facility
  1 33 notification center, more commonly known as one-call.  Current
  1 34 Code language requires that if the board of directors selects
  1 35 a vendor to provide the notification service, the agreement
  2  1 should be reviewed with an opportunity to receive new bids
  2  2 through a competitive bidding process no less frequently than
  2  3 every three years.  The bill removes the obligation to have
  2  4 the process occur at least every three years, and gives the
  2  5 board the option to extend the contract for up to three years.
  2  6 The contract may still be modified by the parties, and is
  2  7 subject to competitive bid at the conclusion of the contract.
  2  8    The bill also divides the paragraph into subparagraphs and
  2  9 subparagraph subdivisions.
