1 1 Section 1. NEW SECTION. 815.14 MINIMUM FEE FOR PUBLIC
1 2 DEFENDER.
1 3 When determining the amount of restitution for each case
1 4 under section 910.3, the expense of a public defender shall at
1 5 least equal twenty-five percent of the fee limitation
1 6 established for the case by the state public defender pursuant
1 7 to section 13B.4.
1 8 EXPLANATION
1 9 This bill relates to establishing a minimum expense for the
1 10 public defender when assessing restitution.
1 11 The bill provides that the assessable expense of the public
1 12 defender shall at least equal 25 percent of the fee limitation
1 13 established by the state public defender for representing an
1 14 indigent person for each type of case. 493 Iowa
1 15 administrative code 12.4 currently establishes the fee
1 16 limitations for the cases. The fee limitation for a class "A"
1 17 felony is $15,000, for a class "B" felony is $3,000, for a
1 18 class "C" felony is $1,200, for a class "D" felony is $1,000,
1 19 for an aggravated misdemeanor is $1,000, for a serious
1 20 misdemeanor is $500, and for a simple misdemeanor is $200.
1 21 Code section 815.7 establishes the rate of compensation for a
1 22 court-appointed attorney at $60 for class "A" felonies, $55
1 23 for class "B" felonies, and $50 for all other court
1 24 appointments.
