  1  1    Section 1.  Section 312.14, Code Supplement 2001, is
  1  2 amended to read as follows:
  1  3    312.14  CITIES TO SUBMIT REPORT – EXCEPTION FOR SMALL
  1  4 CITIES.
  1  5    Cities in the state which receive allotments A city that
  1  6 receives an allotment of funds from road use tax funds shall
  1  7 prepare and deliver on or before September 30 each year to the
  1  8 department an annual report showing all street receipts and
  1  9 expenditures for the city for the previous fiscal year.  This
  1 10 section does not apply to a city with a population of five
  1 11 thousand or less.
  1 12    Sec. 2.  Section 312.15, Code 2001, is amended to read as
  1 13 follows:
  1 14    312.15  WHEN FUNDS NOT ALLOCATED.
  1 15    1.  Funds shall not be allocated to any a city until such
  1 16 the city shall have complied complies with the provisions of
  1 17 sections 312.11 and 312.14, if required to do so.
  1 18    2.  If a city has not complied with the provisions of
  1 19 section 312.14, the treasurer of state shall withhold funds
  1 20 allocated to the city until the city complies.  If a city has
  1 21 not complied with the provisions of section 312.14 by December
  1 22 31 following the date the report was required, funds shall not
  1 23 be allocated to the city until the city has complied and all
  1 24 funds withheld under this paragraph subsection shall revert to
  1 25 the street construction fund of the cities.
  1 26    3.  The department shall notify the treasurer of state if
  1 27 any a city fails to comply with the provisions of sections
  1 28 section 312.11 and or 312.14.  
  1 29                           EXPLANATION
  1 30    This bill exempts cities with a population of 5,000 or less
  1 31 from a provision requiring a city that receives an allotment
  1 32 of funds from road use tax funds to annually report the city's
  1 33 street receipts and expenditures.  By providing such
  1 34 exemption, the bill also excludes such a city from a possible
  1 35 withholding by the treasurer of state of a city's allotment of
  2  1 funds from road use tax funds due to failure to timely submit
  2  2 the report.
