  1  1    Section 1.  Section 99E.3, subsection 3, Code 2001, is
  1  2 amended to read as follows:
  1  3    3.  The commissioner may employ, with the approval of the
  1  4 director, clerks, stenographers, inspectors, agents, and other
  1  5 employees pursuant to chapter 19A as necessary to carry out
  1  6 this chapter, except as provided in section 99E.14.  The
  1  7 commissioner may require a background investigation to be
  1  8 conducted in connection with the employment of lottery
  1  9 employees.  The board shall define, by rule, the employment
  1 10 categories subject to investigation.  The background
  1 11 investigation by the division of criminal investigation of the
  1 12 department of public safety may include a national criminal
  1 13 history record check through the federal bureau of
  1 14 investigation.  The screening of lottery employees through the
  1 15 federal bureau of investigation shall be conducted by
  1 16 submission of fingerprints through the state criminal history
  1 17 record repository to the federal bureau of investigation.
  1 18    Sec. 2.  Section 99E.9, subsection 2, Code 2001, is amended
  1 19 to read as follows:
  1 20    2.  Subject to the approval of the board, the commissioner
  1 21 may enter into contracts for the operation and marketing of
  1 22 the lottery, except that the board may by rule designate
  1 23 classes of contracts other than major procurements which do
  1 24 not require prior approval by the board.  A major procurement
  1 25 shall be as the result of competitive bidding with the
  1 26 contract being awarded to the responsible vendor submitting
  1 27 the lowest and best proposal.  However, before a contract for
  1 28 a major procurement is awarded, the division of criminal
  1 29 investigation of the department of public safety shall conduct
  1 30 a thorough background investigation of the vendor, any parent
  1 31 or subsidiary corporation of the vendor, all shareholders of
  1 32 five percent or more interest of the vendor or parent or
  1 33 subsidiary corporation of the vendor, and all officers and
  1 34 directors of the vendor or parent or subsidiary corporation of
  1 35 the vendor to whom the contract is to be awarded.  The
  2  1 commissioner and board shall consult with the division of
  2  2 criminal investigation and shall provide, by rule, for the
  2  3 parameters of the thorough background investigations and due
  2  4 diligence with regard to the background investigations to be
  2  5 conducted in connection with major procurements.  The vendor
  2  6 shall submit to the division of criminal investigation
  2  7 appropriate investigation authorizations to facilitate this
  2  8 investigation.  A contract for a major procurement awarded or
  2  9 entered into by the commissioner with an individual or
  2 10 business organization shall require that individual or
  2 11 business organization to establish a permanent office in this
  2 12 state.  The background investigation by the division of
  2 13 criminal investigation may include a national criminal history
  2 14 record check through the federal bureau of investigation.  The
  2 15 screening of vendors or their employees through the federal
  2 16 bureau of investigation shall be conducted by submission of
  2 17 fingerprints through the state criminal history record
  2 18 repository to the federal bureau of investigation.  As used in
  2 19 this subsection, "major procurement" means consulting
  2 20 agreements and the major procurement contract with a business
  2 21 organization for the printing of tickets, or for purchase or
  2 22 lease of equipment or services essential to the operation of a
  2 23 lottery game.
  2 24    Sec. 3.  Section 99E.9, subsection 3, paragraph m, Code
  2 25 2001, is amended to read as follows:
  2 26    m.  The form and type of marketing, informational, and
  2 27 educational material to be permitted.  Marketing material and
  2 28 campaigns shall include the concept of investing in Iowa's
  2 29 economic development and show the economic development
  2 30 initiatives funded from lottery revenue.
  2 31    Sec. 4.  Section 99E.9, subsection 3, paragraph o, Code
  2 32 2001, is amended by striking the paragraph.  
  2 33                           EXPLANATION
  2 34    This bill amends the Iowa lottery laws relating to
  2 35 background investigations for lottery employees and contract
  3  1 vendors and their employees, the content of marketing
  3  2 materials, and the imprint of a licensee's name and address on
  3  3 instant lottery tickets.
  3  4    Code section 99E.3, subsection 3, is amended to authorize
  3  5 the commissioner to require background investigations in
  3  6 connection with the employment of lottery employees.  The
  3  7 lottery board shall define, by rule, the employment categories
  3  8 subject to the investigation.  The investigation may include a
  3  9 national criminal history record check through the federal
  3 10 bureau of investigation.
  3 11    Code section 99E.9, subsection 2, is amended to authorize
  3 12 the lottery commissioner and the lottery board to consult with
  3 13 the division of criminal investigation of the department of
  3 14 public safety and provide, by rule, the parameters of thorough
  3 15 background investigations of vendors and their employees
  3 16 needed in connection with major procurements.  Specific
  3 17 language requiring a background investigation of a parent or
  3 18 subsidiary corporation of a vendor, all shareholders of 5
  3 19 percent or more of a vendor or parent or subsidiary
  3 20 corporation, and all officers and directors of a vendor or
  3 21 parent or subsidiary corporation of a vendor is stricken.  The
  3 22 background investigations may include national criminal
  3 23 history record checks through the federal bureau of
  3 24 investigation.  A requirement is also stricken that provides
  3 25 that an individual or business awarded a major procurement
  3 26 shall establish a permanent office in this state.
  3 27    Code section 99E.9, subsection 3, paragraph "m", is amended
  3 28 to strike a requirement that lottery marketing materials and
  3 29 campaigns include the concept of investing in Iowa's economic
  3 30 development and show the economic development initiatives
  3 31 funded from lottery revenue.
  3 32    Code section 99E.9, subsection 3, paragraph "o", is
  3 33 stricken.  This paragraph requires that a lottery licensee
  3 34 either print or stamp the licensee's name and address on the
  3 35 back of each instant ticket except pull-tab tickets.
