  1  1    Section 1.  Section 20.21, unnumbered paragraph 3, Code
  1  2 2001, is amended to read as follows:
  1  3    However, the board shall not appoint a fact-finder
  1  4 representative of the public if the public employees
  1  5 represented by a certified employee organization are teachers
  1  6 licensed under chapter 272 and the public employer is a school
  1  7 district, community college, or area education agency, or are
  1  8 instructors and the public employer is a community college.
  1  9 The board shall adopt rules regarding the time period after
  1 10 mediation when binding arbitration procedures must begin for
  1 11 teachers or instructors exempt from this section.
  1 12    Sec. 2.  Section 232.69, subsection 1, paragraph b,
  1 13 subparagraph (4), Code Supplement 2001, is amended to read as
  1 14 follows:
  1 15    (4)  A licensed school employee, certified para-educator,
  1 16 or holder of a coaching authorization issued under section
  1 17 272.31, or an instructor employed by a community college.
  1 18    Sec. 3.  Section 257.11, subsection 3, paragraph b,
  1 19 unnumbered paragraph 1, Code Supplement 2001, is amended to
  1 20 read as follows:
  1 21    If the school budget review committee certifies to the
  1 22 department of management that the class would not otherwise be
  1 23 implemented without the assignment of additional weighting,
  1 24 pupils attending a community college-offered class or
  1 25 attending a class taught by a community college-employed
  1 26 teacher instructor are assigned a weighting of forty-eight
  1 27 hundredths of the percentage of the pupil's school day during
  1 28 which the pupil attends class in the community college or
  1 29 attends a class taught by a community college-employed teacher
  1 30 instructor.  The following requirements shall be met for the
  1 31 purposes of assigning an additional weighting for classes
  1 32 offered through a sharing agreement between a school district
  1 33 and community college.  The class must be:
  1 34    Sec. 4.  Section 257.11, subsection 3, paragraph b,
  1 35 subparagraph (5), Code Supplement 2001, is amended to read as
  2  1 follows:
  2  2    (5)  Taught by a teacher meeting community college
  2  3 licensing requirements college-employed instructor.
  2  4    Sec. 5.  Section 260C.36, Code 2001, is amended to read as
  2  5 follows:
  2  6    260C.36  QUALITY FACULTY DEVELOPMENT AND STAFF PLAN.
  2  7    1.  On October 1, 2002, the administration of the college
  2  8 shall appoint a committee of instructors, equally
  2  9 representative of the arts and sciences faculty and the
  2 10 vocational technical faculty, which has no more than a simple
  2 11 majority of members of the same gender.  The committee shall
  2 12 develop a plan for hiring and developing quality staff that
  2 13 includes all of the following:
  2 14    a.  An implementation schedule for the plan.
  2 15    b.  Orientation procedures for new faculty and staff.
  2 16    c.  Continuing professional development for faculty and
  2 17 staff.
  2 18    d.  Procedures for accurate recordkeeping and documentation
  2 19 for plan monitoring.
  2 20    e.  Consortium arrangements when appropriate, cost-
  2 21 effective and mutually beneficial.
  2 22    f.  Specific activities that ensure faculty attain and
  2 23 demonstrate instructional competencies and knowledge in their
  2 24 subject or technical areas.
  2 25    g.  Procedures for collection and maintenance of records
  2 26 demonstrating that each faculty member has attained or
  2 27 documented progress toward attaining minimal competencies.
  2 28    2.  The committee shall submit the plan to the board of
  2 29 directors, which shall consider the plan and, once approved,
  2 30 submit the plan to the department of education and implement
  2 31 the plan not later than July 1, 2003.
  2 32    3.  Between July 1, 2003, and June 30, 2006, the department
  2 33 of education shall conduct annual on-site visits at each
  2 34 community college to ensure each community college's
  2 35 compliance and progress in implementing its plan.  By July 1,
  3  1 2006, the department shall submit a report summarizing the
  3  2 department's findings to each community college and to the
  3  3 state accreditation team appointed pursuant to section
  3  4 260C.47.
  3  5    4.  The administration of the college shall encourage the
  3  6 continued development of faculty potential by doing all of the
  3  7 following:
  3  8    (1) a.  Regularly stimulating department chairpersons or
  3  9 heads to meet their responsibilities in this regard; (2)
  3 10 lightening for the continued development of faculty potential.
  3 11    b.  Reducing the teaching instructional loads of first-year
  3 12 instructors whose course preparation and in-service training
  3 13 demand it; (3) stimulating a reduction.
  3 14    c.  Stimulating curricular evaluation; and (4) encouraging.
  3 15    d.  Encouraging the development of an atmosphere in which
  3 16 the faculty brings a wide range of ideas and experiences to
  3 17 the students, each other, and the community.
  3 18    Sec. 6.  Section 260C.47, subsection 1, unnumbered
  3 19 paragraph 1, Code 2001, is amended to read as follows:
  3 20    The state board of education shall establish an
  3 21 accreditation process for community college programs by July
  3 22 1, 1997.  The process shall be jointly developed and agreed
  3 23 upon by the department of education and the community
  3 24 colleges.  The state accreditation process shall be integrated
  3 25 with the accreditation process of the north central
  3 26 association of colleges and schools, including the evaluation
  3 27 cycle, the self-study process, and the criteria for
  3 28 evaluation, which shall incorporate the standards for
  3 29 community colleges developed under section 260C.48; and shall
  3 30 identify and make provision for the needs of the state that
  3 31 are not met by the association's accreditation process.  For
  3 32 the academic year commencing July 1, 1998, and in succeeding
  3 33 school years, the department of education shall use a two-
  3 34 component process for the continued accreditation of community
  3 35 college programs.  Beginning July 1, 2006, the state
  4  1 accreditation process shall incorporate the standards
  4  2 developed pursuant to section 260C.48, subsection 4.
  4  3    Sec. 7.  Section 260C.47, subsection 1, paragraph b, Code
  4  4 2001, is amended to read as follows:
  4  5    b.  The second component consists of the use of an
  4  6 accreditation team appointed by the director of the department
  4  7 of education, to conduct an evaluation, including an on-site
  4  8 visit of each community college, with a comprehensive
  4  9 evaluation to occur during the same year as the evaluation by
  4 10 the north central association of colleges and schools, and an
  4 11 interim evaluation midway between comprehensive evaluations.
  4 12 The number and composition of the accreditation team shall be
  4 13 determined by the director, but the team shall include members
  4 14 of the department of education staff and community college
  4 15 staff members from community colleges other than the community
  4 16 college that conducts the programs being evaluated for
  4 17 accreditation.  Beginning July 1, 2006, the accreditation team
  4 18 shall monitor the quality faculty and staff plan implemented
  4 19 by each community college pursuant to section 260C.36.
  4 20    Sec. 8.  Section 260C.48, subsection 1, Code 2001, is
  4 21 amended to read as follows:
  4 22    1.  The state board shall develop standards and rules for
  4 23 the accreditation of community college programs.  Standards
  4 24 Except as provided in subsection 4, standards developed shall
  4 25 be general in nature so as to apply to more than one specific
  4 26 program of instruction.
  4 27    Sec. 9.  Section 260C.48, Code 2001, is amended by adding
  4 28 the following new subsection:
  4 29    NEW SUBSECTION.  4.  Commencing July 1, 2006, standards
  4 30 developed relating to quality assurance of faculty and ongoing
  4 31 professional development shall be site-specific with regard to
  4 32 the quality faculty and staff plan implemented by each
  4 33 community college pursuant to 260C.36.
  4 34    Sec. 10.  Section 272.1, subsection 11, Code 2001, is
  4 35 amended to read as follows:
  5  1    11.  "School" means a school under section 280.2, a
  5  2 community college, an area education agency, and a school
  5  3 operated by a state agency for special purposes.
  5  4    Sec. 11.  Section 272.3, subsection 5, Code 2001, is
  5  5 amended by striking the subsection.
  5  6    Sec. 12.  Section 272.33, unnumbered paragraph 1, Code
  5  7 2001, is amended to read as follows:
  5  8    In addition to licenses required under rules adopted
  5  9 pursuant to this chapter, an individual employed as an
  5 10 administrator, supervisor, school service person, or teacher
  5 11 by a school district, or area education agency, or community
  5 12 college, who conducts evaluations of the performance of
  5 13 individuals holding licenses under this chapter, shall possess
  5 14 an evaluator license or an evaluator endorsement appearing on
  5 15 a teaching or administrative license.  Individuals employed in
  5 16 community colleges who do not directly supervise licensed
  5 17 teaching faculty are exempt from this section.
  5 18    Sec. 13.  Section 279.13, Code Supplement 2001, is amended
  5 19 by adding the following new subsection:
  5 20    NEW SUBSECTION.  4.  For purposes of this section, sections
  5 21 279.14, 279.15 through 279.17, and 279.27, unless the context
  5 22 otherwise requires, "teacher" includes an instructor employed
  5 23 by a community college.
  5 24    Sec. 14.  Section 279.18, Code 2001, is amended by adding
  5 25 the following new unnumbered paragraph:
  5 26    NEW UNNUMBERED PARAGRAPH.  For purposes of this section,
  5 27 unless the context otherwise requires, "rejecting party" shall
  5 28 include, but not be limited to, an instructor employed by a
  5 29 community college.
  5 30    Sec. 15.  EFFECTIVE DATE.  Sections 1 through 4 and
  5 31 sections 6 through 14 of this Act take effect July 1, 2003.  
  5 32                           EXPLANATION 
  5 33    This bill eliminates licensure of community college faculty
  5 34 from the responsibilities of the board of educational
  5 35 examiners.  The bill requires each community college
  6  1 administration to appoint a committee to develop a quality
  6  2 faculty and staff plan, which must be submitted to and
  6  3 approved by the board of directors of the community college,
  6  4 and submitted to the department of education and implemented
  6  5 by July 1, 2003.
  6  6    The plan must include an implementation schedule for the
  6  7 plan, orientation procedures, continuing professional
  6  8 development, recordkeeping procedures and documentation,
  6  9 consortium arrangements, and activities that ensure
  6 10 instructional competencies and subject knowledge.
  6 11    The bill also requires the department to conduct on-site
  6 12 visits at community colleges between July 1, 2003, and June
  6 13 30, 2006, to ensure that each community college is making
  6 14 progress in implementing its plan.  By July 1, 2006, the
  6 15 department must submit a report summarizing its findings to
  6 16 each community college and to the state team responsible for
  6 17 the accreditation of community colleges; and the state
  6 18 accreditation teams must monitor the plans and incorporate in
  6 19 the accreditation standards for community college standards
  6 20 developed with regard to the plan.
  6 21    The bill also makes Code changes related to the elimination
  6 22 of community college practitioner licensure requirements.  For
  6 23 example, under the bill, community college instructors remain
  6 24 mandatory child abuse reporters and supplementary weighting
  6 25 for district-to-community college sharing continues, though
  6 26 the Code language is amended to substitute the term "community
  6 27 college-employed instructors" for "community college-employed
  6 28 teachers".
  6 29    Only the provision requiring community college
  6 30 administrators to appoint a committee to develop a plan takes
  6 31 effect July 1, 2002.  The remaining provisions take effect
  6 32 July 1, 2003.
