PAG LIN
  1  1    Section 1.  TREASURER OF STATE.  There is appropriated from
  1  2 the general fund of the state to the treasurer of state for
  1  3 the fiscal year beginning July 1, 2001, and ending June 30,
  1  4 2002, the following amount, or so much thereof as is
  1  5 necessary, to be used for the purpose designated:
  1  6    For debt service:  
  1  7 .................................................. $ 11,405,000
  1  8    Funds appropriated in this section shall be deposited in a
  1  9 separate fund established in the office of the treasurer of
  1 10 state to be used solely for debt service for the Iowa
  1 11 communications network.  The Iowa telecommunications and
  1 12 technology commission shall certify to the treasurer of state
  1 13 when a debt service payment is due, and upon receipt of the
  1 14 certification, the treasurer shall make the payment.  The
  1 15 commission shall pay any additional amount due from funds
  1 16 deposited in the Iowa communications network fund.
  1 17    Sec. 2.  IOWA COMMUNICATIONS NETWORK OPERATIONS.
  1 18    1.  There is appropriated from the general fund of the
  1 19 state to the Iowa telecommunications and technology commission
  1 20 for the fiscal year beginning July 1, 2001, and ending June
  1 21 30, 2002, the following amount, or so much thereof as is
  1 22 necessary, to be used for the purposes designated in this
  1 23 subsection:
  1 24    For operations of the network consistent with chapter 8D
  1 25 and for the following full-time equivalent positions:  
  1 26 .................................................. $  2,234,330
  1 27 ................................................ FTEs    104.00
  1 28    2.  Notwithstanding section 8.33 or 8.39, moneys
  1 29 appropriated in this section which remain unobligated or
  1 30 unexpended at the close of the fiscal year shall not revert
  1 31 but shall remain available for the purposes designated in the
  1 32 succeeding fiscal year, and shall not be transferred to any
  1 33 other program.
  1 34    3.  It is the intent of the general assembly that the Iowa
  1 35 telecommunications and technology commission annually review
  2  1 the hourly rates established, as provided in section 8D.3,
  2  2 subsection 3, paragraph "i", consistent with this paragraph.
  2  3 Such rates shall be established in a manner to minimize any
  2  4 subsidy provided through state general fund appropriations.
  2  5    Sec. 3.  PUBLIC BROADCASTING.  There is appropriated from
  2  6 the general fund of the state to the public broadcasting
  2  7 division of the department of education for the fiscal year
  2  8 beginning July 1, 2001, and ending June 30, 2002, the
  2  9 following amount, or so much thereof as is necessary, to be
  2 10 used for the purposes designated in subsections 1 and 2 and
  2 11 for the following full-time equivalent positions:  
  2 12 .................................................. $  1,526,808
  2 13 ............................................... FTEs       8.00
  2 14    1.  Of the amount appropriated in this section, $322,156
  2 15 shall be expended by the public broadcasting division of the
  2 16 department of education to provide support for functions
  2 17 related to the network, including but not limited to the
  2 18 following functions:  development of distance learning
  2 19 applications; development of a central information source on
  2 20 the internet relating to educational uses of the network;
  2 21 second-line technical support for network sites; testing and
  2 22 initializing sites onto the network; and coordinating the work
  2 23 of the education telecommunications council.
  2 24    2.  Of the amount appropriated in this section, $1,204,652
  2 25 shall be allocated by the public broadcasting division of the
  2 26 department of education to the regional telecommunications
  2 27 councils established in section 8D.5.  The regional
  2 28 telecommunications councils shall use the funds to provide
  2 29 technical assistance for network classrooms, planning and
  2 30 troubleshooting for local area networks, scheduling of video
  2 31 sites, and other related support activities.
  2 32    Sec. 4.  INFORMATION TECHNOLOGY DEPARTMENT.  There is
  2 33 appropriated from the general fund of the state to the
  2 34 information technology department for the fiscal year
  2 35 beginning July 1, 2001, and ending June 30, 2002, the
  3  1 following amount, or so much thereof as is necessary, to be
  3  2 used for the purpose designated:
  3  3    For the purpose of providing information technology
  3  4 services to state agencies and for the following full-time
  3  5 equivalent positions:  
  3  6 .................................................. $  3,233,862
  3  7 ............................................... FTEs     174.31
  3  8    1.  The information technology department shall not
  3  9 increase any fees or charges to other state agencies for
  3 10 services provided to such state agencies by the department,
  3 11 unless such increase in fees or charges is first reported to
  3 12 the department of management.  The department of management
  3 13 shall submit a report notifying the legislative fiscal bureau
  3 14 regarding any fee increase as the increase occurs.
  3 15    2.  The information technology department is authorized to
  3 16 enter into agreements with other departments, agencies,
  3 17 boards, and commissions for the provision of information
  3 18 technology services.  During the development of such
  3 19 agreements, the agreeing parties shall identify any and all
  3 20 direct cost savings to be realized in the provision of these
  3 21 services.  Once these savings from the agreement are
  3 22 identified, the information technology department shall notify
  3 23 the department of management of the savings so identified.
  3 24 The department of management shall then cause the amount of
  3 25 savings realized from the agreement to be transferred to the
  3 26 information technology department revolving fund for the
  3 27 purpose of providing information technology services to state
  3 28 agencies.  The department of management shall annually report
  3 29 the amount transferred by each department to the legislative
  3 30 fiscal bureau.
  3 31    Sec. 5.  POOLED TECHNOLOGY ACCOUNT.
  3 32    1.  Notwithstanding section 8.57, subsection 5, paragraph
  3 33 "c", there is appropriated from the rebuild Iowa
  3 34 infrastructure fund to the pooled technology account
  3 35 established in the office of the treasurer of state under the
  4  1 control of the information technology department, for the
  4  2 fiscal year beginning July 1, 2001, and ending June 30, 2002,
  4  3 the following amount, or so much thereof as is necessary, to
  4  4 be used for the purpose designated:
  4  5    For the support of various technology programs:  
  4  6 .................................................. $ 13,000,000
  4  7    Moneys appropriated pursuant to this section are allocated
  4  8 in the descending priority order for use during the fiscal
  4  9 year beginning July 1, 2001, and ending June 30, 2002, as
  4 10 follows:
  4 11    a.  The first $3,000,000 shall be allocated to the
  4 12 department of education for transfer to the community colleges
  4 13 for the development and implementation of information
  4 14 technology.
  4 15    b.  The next $1,500,000 shall be allocated to the
  4 16 university of northern Iowa for developing a twenty-first
  4 17 century learning initiative.  The university of northern Iowa
  4 18 shall consult with information technology department and the
  4 19 department of education in developing this initiative.  Of the
  4 20 funds allocated pursuant to this paragraph, $250,000 shall be
  4 21 transferred to the legislative council to establish an office
  4 22 of distance learning.  The objective of the office of distance
  4 23 learning shall be to establish the state of Iowa as a distance
  4 24 learning center.  The legislative council shall be authorized
  4 25 to hire individuals for office staffing positions, which
  4 26 positions shall report to the legislative oversight committee.
  4 27 The office of distance learning may receive and utilize grants
  4 28 and other funds in addition to amounts appropriated pursuant
  4 29 to this paragraph.  The office of distance learning shall
  4 30 identify and facilitate distance learning technology and
  4 31 applications between all interested agencies and entities
  4 32 involved or potentially involved in distance learning
  4 33 activities including, but not limited to, k-12 schools, area
  4 34 education agencies, institutions of higher learning, Iowa
  4 35 public television, the department of education, the Iowa
  5  1 communications network, the information technology department,
  5  2 and military and private sector institutions or agencies.
  5  3 Amounts which remain unallocated or unexpended at the close of
  5  4 the fiscal year shall revert to the pooled technology account
  5  5 for the support of technology programs in the succeeding
  5  6 fiscal year.
  5  7    c.  The next $1,500,000 shall be allocated to the
  5  8 department of education for purposes of making technology
  5  9 available to students of accredited nonpublic schools in
  5 10 accordance with section 8 of this Act.
  5 11    d.  The next $2,727,000 shall be allocated to the Iowa
  5 12 telecommunications and technology commission for maintenance
  5 13 and lease costs associated with Part III connections.
  5 14    e.  The next $4,273,000 shall be allocated to the
  5 15 information technology department only for designated
  5 16 projects.
  5 17    2.  A department or agency receiving an appropriation under
  5 18 subsection 1 shall consult with the information technology
  5 19 department regarding any technology purchase, lease, or
  5 20 contract, prior to making a purchase or entering into a lease
  5 21 or contract.
  5 22    3.  The department of management, in cooperation with the
  5 23 information technology department, shall develop a standard
  5 24 budget request form for technology or business reengineering
  5 25 projects.  A department requesting funding for projects which
  5 26 will cost more than $100,000 shall use the request form.  The
  5 27 form shall require consistent reporting criteria including,
  5 28 but not limited to, project description, project goals,
  5 29 project performance measures, return on investment, cost, time
  5 30 frame, funding sources, and customer base.
  5 31    Sec. 6.  FUNDING FOR IOWACCESS.
  5 32    1.  Notwithstanding section 321A.3, subsection 1, for the
  5 33 fiscal year beginning July 1, 2001, and ending June 30, 2002,
  5 34 the first $1,000,000 collected and transferred by the
  5 35 department of transportation to the treasurer of state with
  6  1 respect to the fees for transactions involving the furnishing
  6  2 of a certified abstract of a vehicle operating record under
  6  3 section 321A.3, subsection 1, shall be transferred to the
  6  4 IowAccess revolving fund created in section 14B.206 and
  6  5 administered by the information technology department for the
  6  6 purposes of developing, implementing, maintaining, and
  6  7 expanding electronic access to government records in
  6  8 accordance with the requirements set forth in chapter 14B.
  6  9    2.  It is the intent of the general assembly that all fees
  6 10 collected with respect to transactions involving IowAccess
  6 11 shall be deposited in the IowAccess revolving fund created in
  6 12 section 14B.206 and shall be used only for the support of
  6 13 IowAccess projects.
  6 14    Sec. 7.  Commencing with the fiscal year beginning July 1,
  6 15 2002, and ending June 30, 2003, and succeeding fiscal years,
  6 16 all state government agencies which produce or make available
  6 17 for public inspection written reports or documents shall
  6 18 utilize IowAccess or another electronic communication
  6 19 mechanism as the primary means of distribution or
  6 20 dissemination of such reports.  A government agency shall
  6 21 furnish a written copy of a report or publication either for
  6 22 distribution at designated public access points or by ordinary
  6 23 or certified mail only as required by specific request.  The
  6 24 objective of this provision shall be the reduction of
  6 25 unnecessary printing and mailing expenses incurred throughout
  6 26 state government.
  6 27    Sec. 8.  Section 14B.203, Code 2001, is amended by adding
  6 28 the following new subsection:
  6 29    NEW SUBSECTION.  5.  Notwithstanding any other provision of
  6 30 this section, the department may establish for the fiscal
  6 31 years beginning July 1, 2001, and ending June 30, 2005, a
  6 32 pilot project for fee collection.  Fees shall be collected
  6 33 based on the ability to access court information from remote
  6 34 locations.
  6 35    Sec. 9.  2000 Iowa Acts, chapter 1226, section 5,
  7  1 subsection 2, is amended by adding the following new
  7  2 paragraph:
  7  3    NEW PARAGRAPH.  dd.  The next $1,400,000 shall be allocated
  7  4 to the treasurer of state for debt service for the Iowa
  7  5 communications network for the fiscal year beginning July 1,
  7  6 2001, and ending June 30, 2002.
  7  7    Sec. 10.  2000 Iowa Acts, chapter 1226, section 5,
  7  8 subsection 2, paragraph e, is amended to read as follows:
  7  9    e.  The next $21,000,000 $19,600,000 shall be allocated to
  7 10 the division of information technology services of the
  7 11 department of general services only for the projects
  7 12 designated in this paragraph as follows:
  7 13    Sec. 11.  TECHNOLOGY SERVICES FOR ACCREDITED NONPUBLIC
  7 14 SCHOOL STUDENTS.
  7 15    1.  Technology adopted and purchased by a school district
  7 16 shall, to the extent funds are appropriated by the general
  7 17 assembly, be made available to students of accredited
  7 18 nonpublic schools located within the boundaries of the school
  7 19 district upon the written request of the authorities in charge
  7 20 of the accredited nonpublic school on behalf of the school's
  7 21 students as provided in this section.
  7 22    2.  Funds appropriated for purposes of this section shall
  7 23 be allocated to school districts for the purchase of
  7 24 technology for accredited nonpublic schools as provided in
  7 25 this section, subject to the restrictions of section 295.4,
  7 26 subsection 1.  The department of education shall ascertain a
  7 27 maximum annual amount the school district shall be required to
  7 28 use for the purchase of technology for participating
  7 29 accredited nonpublic schools.  The amount shall be in the
  7 30 proportion that the basic enrollment of a participating
  7 31 accredited nonpublic school bears to the sum of the basic
  7 32 enrollments of all participating accredited nonpublic schools
  7 33 in the state for the budget year.  A participating accredited
  7 34 nonpublic school shall certify its actual enrollment to the
  7 35 department of education by October 1, 2001.  By October 15,
  8  1 2001, the department of education shall notify the board of
  8  2 directors of each school district of the maximum amount of its
  8  3 allocation that shall be made available for purchasing
  8  4 nonsectarian, nonreligious technology for each of the
  8  5 participating accredited nonpublic schools located within the
  8  6 school district in accordance with this section.  For purposes
  8  7 of this section only, an accredited nonpublic school's
  8  8 enrollment count shall include only students who are residents
  8  9 of Iowa.
  8 10    3.  The costs of providing technology to participating
  8 11 accredited nonpublic schools as provided in this section shall
  8 12 not be included in the computation of district cost under
  8 13 chapter 257, but shall be shown in the budget as an expense
  8 14 from miscellaneous income.  Technology expenditures made in
  8 15 accordance with this section shall be kept on file in the
  8 16 school district.
  8 17    Sec. 12.  POOLED TECHNOLOGY FUNDING – PRIOR ALLOCATIONS.
  8 18    1.  Notwithstanding section 8.33, moneys allocated in 2000
  8 19 Iowa Acts, chapter 1226, section 5, subsection 2, paragraphs
  8 20 "a" through "c", and paragraph "dd", as enacted by this Act,
  8 21 which remain unobligated or unexpended at the close of the
  8 22 fiscal year shall not revert but shall remain available for
  8 23 expenditure for the purpose for which allocated for the fiscal
  8 24 year beginning July 1, 2001, and ending June 30, 2002.
  8 25    2.  Notwithstanding section 8.33, the remaining balance of
  8 26 the moneys allocated to the information technology department
  8 27 in 2000 Iowa Acts, chapter 1226, section 5, subsection 2,
  8 28 paragraph "e", which remain unobligated or unexpended at the
  8 29 close of the fiscal year shall not revert but shall remain
  8 30 available for expenditure by the information technology
  8 31 department for technology purposes for the fiscal year
  8 32 beginning July 1, 2001, and ending June 30, 2002.
  8 33    Sec. 13.  DISTANCE LEARNING – STUDY.  The legislative
  8 34 council is requested to establish an interim study committee
  8 35 relating to distance learning and related Iowa communications
  9  1 network educational issues.  The committee is directed to
  9  2 submit its findings, with any recommendations, in a report to
  9  3 the general assembly not later than January 15, 2002.
  9  4    Sec. 14.  EFFECTIVE DATE.  Sections 9, 10, and 12 of this
  9  5 Act, being deemed of immediate importance, take effect upon
  9  6 enactment.  
  9  7                           EXPLANATION
  9  8    This bill relates to state government technology operations
  9  9 by making appropriations to a number of entities for such
  9 10 technology.  Specifically, the bill makes appropriations for
  9 11 the 2001-2002 fiscal year from the general fund of the state
  9 12 for debt service associated with the Iowa communications
  9 13 network, for subsidization of operations of the network
  9 14 necessary as a result of charging authorized users video rates
  9 15 which generate less revenue than necessary to cover associated
  9 16 costs of the network, for support functions related to the
  9 17 network provided by the public broadcasting division of the
  9 18 department of education, and for information technology
  9 19 services provided by the information technology department to
  9 20 other state agencies.
  9 21    The bill also makes an appropriation for the 2001-2002
  9 22 fiscal year from the rebuild Iowa infrastructure fund to the
  9 23 pooled technology account created in the office of the
  9 24 treasurer of state under the control of the information
  9 25 technology department for the support of various technology
  9 26 programs.  The technology programs specified are to be funded
  9 27 in the order provided in the bill.
  9 28    The bill provides for funding for IowAccess and provides
  9 29 that all fees collected associated with transactions through
  9 30 IowAccess are to be deposited in the IowAccess revolving fund
  9 31 created in Code section 14B.206 and shall be used only for the
  9 32 support of IowAccess projects.  The bill provides that the
  9 33 information technology department may establish for the fiscal
  9 34 years beginning July 1, 2001, and ending June 30, 2005, a
  9 35 pilot project regarding fee collection for electronic access
 10  1 to court information.
 10  2    The bill provides that technology adopted and purchased by
 10  3 a school district, to the extent funds are appropriated by the
 10  4 general assembly, shall be made available to students of
 10  5 accredited nonpublic schools located within the boundaries of
 10  6 the school district upon the written request of the
 10  7 authorities in charge of the accredited nonpublic school on
 10  8 behalf of the school's students.
 10  9    The bill provides that the department of information
 10 10 technology is authorized to enter into agreements with other

 10 22    The bill provides that commencing with the 2002-2003 fiscal
 10 23 year, and succeeding fiscal years, all state government
 10 24 agencies which produce or make available for public inspection
 10 25 written reports or documents shall utilize IowAccess or
 10 26 another electronic communication mechanism as the primary
 10 27 means of distribution or dissemination of such reports.  The
 10 28 bill also provides that the legislative council is requested
 10 29 to establish an interim study committee relating to distance
 10 30 learning and related Iowa communications network educational
 10 31 issues.
 10 32    The bill provides for the nonreversion of specified moneys
 10 33 allocated from the pooled technology account for the 2000-2001
 10 34 fiscal year which remain unobligated or unexpended at the
 10 35 close of the fiscal year, and provides that moneys allocated
 11  1 to the information technology department in 2000 Iowa Acts,
 11  2 chapter 1226, section 5, subsection 2, paragraph "e", which
 11  3 remain unobligated or unexpended at the close of the fiscal
 11  4 year shall not revert but shall be appropriated to the
 11  5 department for technology purposes for the 2001-2002 fiscal
 11  6 year.  The bill also provides for an allocation of $1.4
 11  7 million out of moneys in the pooled technology account to the
 11  8 treasurer of state for debt service for the Iowa
 11  9 communications network for the 2001-2002 fiscal year.
 11 10    The bill provides that the portions of the bill providing
 11 11 for the nonreversion of moneys allocated from the pooled
 11 12 technology account take effect upon enactment.
